HomeMy WebLinkAboutRES 368 Draft 01 2012-2014 +t�or, COUNTY OF HAWAII STATE OF HAWAI I RESOLUTION NO. 368 14 RESOLUTION PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTIES BY EMINENT DOMAIN, BEING PORTIONS OF TAX MAP KEY: (3) 2-2-027:058 (PARCEL 2), (3) 2-2-036:019 (PARCEL 16), (3) 2-2-036:018 (PARCEL 17) and (3) 2-2-036:077 (PARCEL 24) SITUATED AT WAIAKEA, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII, FOR THE DEVELOPMENT AND CONSTRUCTION OF A RIGHT OF WAY PARCEL NEEDED FOR THE MANONO STREET IMPROVEMENTS, JOB NO. P-3828. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS,the County of Hawai`i is proceeding with the widening of Manono Street between Lanikaula and Kekuanao`a Streets; WHEREAS,the project seeks to improve bicycle and pedestrian accessibility and vehicular circulation, as well as drainage conditions in the area; WHEREAS, the development and completion of the construction of the widening of Manono Street, that is, Manono Street Improvements, Job No. P-3828, would entail the acquiring by the County of Hawai`i of portions of additional lands described as follows in: Exhibits "1", legal description, and "2", parcel map, attached hereto and made a part hereof, for Parcel 2 consisting of approximately 500 square feet, more or less; Exhibits "3", legal description, and "4"parcel map, attached hereto and made a part hereof, for Parcel 16 consisting of approximately 500 square feet, more or less; Exhibits "5", legal description, and "6"parcel map, attached hereto and made a part hereof, for Parcel 17 consisting of approximately 1,793 square feet, more or less; Exhibits "7", legal description, and"8" parcel map, attached hereto and made a part hereof, for Parcel 24 consisting of approximately 500 square feet, more or less; and together with any adjacent lands necessary for temporary construction purposes, including but not limited to,temporary easements for construction and operations, storage and disposal areas; and WHEREAS,the completion of the widening of Manono Street has been determined by the County of Hawai`i as providing a public use and purpose which will benefit the County of Hawai`i; WHEREAS, the County of Hawai`i deems it necessary to invoke its condemnation powers in acquiring the additional lands to complete the widening of Manono Street; and WHEREAS, Section 101-13 of the Hawai`i Revised Statutes requires that a condemnation action by the County of Hawai`i must be authorized by a resolution of the County Council. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Council of the County of Hawai`i finds that it is necessary for the public use and purpose for the benefit of the County of Hawai`i, to wit: the widening of Manono Street at Waiakea, District of South Hilo, County and State of Hawai`i, to take, acquire and condemn portions of the additional lands described as follows : Exhibits"1", legal description, and"2", parcel map, attached hereto and made a part hereof, for Parcel 2 consisting of approximately 500 square feet, more or less; Exhibits "3", legal description, and"4"parcel map, attached hereto and made a part hereof, for Parcel 16 consisting of approximately 500 square feet, more or less; Exhibits "5", legal description, and "6"parcel map, attached hereto and made a part hereof, for Parcel 17 consisting of approximately 1,793 square feet, more or less; Exhibits "7", legal description, and "8" parcel map, attached hereto and made a part hereof, for Parcel 24 consisting of approximately 500 square feet, more or less; and together with any adjacent lands necessary for temporary construction purposes, including but not limited to, temporary easements for construction and operations, storage and disposal areas. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby authorized and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, acquisition and condemnation of the aforesaid land. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the process of said proceedings in eminent domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms of settlement, subject to the approval of the Court before which such proceedings are prosecuted. BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii is directed to transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of Hawaii; (2) the Department of Public Works; (3) to all subject landowners; and (4) Senior Deputy Corporation Counsel Joseph K. Kamelamela.
