WHEREAS,the completion of the widening of Manono Street has been determined by <br /> the County of Hawai`i as providing a public use and purpose which will benefit the County of <br /> Hawai`i; <br /> WHEREAS, the County of Hawai`i deems it necessary to invoke its condemnation <br /> powers in acquiring the additional lands to complete the widening of Manono Street; and <br /> WHEREAS, Section 101-13 of the Hawai`i Revised Statutes requires that a <br /> condemnation action by the County of Hawai`i must be authorized by a resolution of the County <br /> Council. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the <br /> Council of the County of Hawai`i finds that it is necessary for the public use and purpose for the <br /> benefit of the County of Hawai`i, to wit: the widening of Manono Street at Waiakea, District of <br /> South Hilo, County and State of Hawai`i, to take, acquire and condemn portions of the additional <br /> lands described as follows : Exhibits"1", legal description, and"2", parcel map, attached hereto <br /> and made a part hereof, for Parcel 2 consisting of approximately 500 square feet, more or less; <br /> Exhibits "3", legal description, and"4"parcel map, attached hereto and made a part hereof, for <br /> Parcel 16 consisting of approximately 500 square feet, more or less; Exhibits "5", legal <br /> description, and "6"parcel map, attached hereto and made a part hereof, for Parcel 17 consisting <br /> of approximately 1,793 square feet, more or less; Exhibits "7", legal description, and "8" parcel <br /> map, attached hereto and made a part hereof, for Parcel 24 consisting of approximately 500 <br /> square feet, more or less; and together with any adjacent lands necessary for temporary <br /> construction purposes, including but not limited to, temporary easements for construction and <br /> operations, storage and disposal areas. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby authorized <br /> and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, <br /> acquisition and condemnation of the aforesaid land. <br />
