3 . Grantee shall provide for an independent <br /> audit of its activities on a periodic basis in accordance with <br /> Office of Management and Budget Circular A-133 . <br /> 4 . Prior to, or concurrently with the execution <br /> of this Contract, if .so required by Agency, Grantee shall <br /> complete, ' execute and submit to Agency' a Certification ' Regarding <br /> Drug-Free Workplace Requirements ,which meets the requirements of <br /> the Drug-Free Workplace Act of 1988 (Pub. L . 100-690, Title V, <br /> Subtitle D, U. S .C. , Title 44 Chapter 10, §702) , hereinafter <br /> referred to as the "Drug-Free Workplace Certification. " A copy <br /> of the Drug-Free Workplace Certification shall be included in <br /> Part .`IV of the Application for Grant . Grantee covenants that <br /> the representations made in the Drug-Free Workplace <br /> . Certification are true at the time this Contract is executed and <br /> will remain true throughout the entire term of this Contract and <br /> any extensions, and that Grantee shall fulfill. all the <br /> requirements set forth therein. Grantee ' s execution and <br /> submission of a false Drug-Free Workplace Certification, or <br /> Grantee ' s violation of any or all of the requirements set forth <br /> therein shall entitle Agency to suspend, one or more payments <br /> under this Contract, and/or terminate. this Contract pursuant to <br /> the provisions of Section N of this Contract . Grantee warrants <br /> that it is aware that such false certification or violation of <br /> the requirements contained in the Drug-Free Workplace <br /> 5 (rev. 12/2013) <br />
