1 n <br />Ifound. (See Addendum Archaeological Inventory Survey, Waikoloa Beach Resort, Adjacent <br />Coastal Parcels, dated May, 1996, prepared by Paul H. Rosendahl, Ph.D., Exhibit 7). <br />A previous undated archaeological/historical sites survey conducted by Cedar <br />Homes of Hawaii --Hawaii described a footpath that skirts the south end of the bi-lobed <br />' anchialine pond which continues east across the a'a flow. This trail was also identified by <br />William Barrera in 1971 as "This trail led from the small pond S of Kuuali'i Fishpond into the <br />district of North Kona through an area of extremely rough, sharp pahoehoe. It was not <br />' marked by coral or cairns, but was deeply wom into the lava." (See Archaeological/Historical <br />Site Survey, prepared by Cedar Homes, Inc., Exhibit 8). <br />' The applicant proposes to submit to DLNR-State Historic Preservation Division <br />an archaeological preservation plan prior to any land altering activity or development on the <br />project site. <br />7. Ate• Access to the project site is provided by means of a private <br />improved road off of Waikoloa Beach Drive, known as the `Anaeho'omalu Beach Park access <br />road. The property is provided with an access easement along this private road by a perpetual <br />recorded easement. This access road also provides pedestrians with shoreline access into <br />r`Anaeho'omalu Beach Park. There is adequate sight distance for vehicles entering and exiting <br />the project site. Queen Kaabumanu Highway, a State owned roadway, is located <br />approximately 3/4 mile mauka or inland of the property. <br />8. Sewage Disposal. The existing cesspool located behind the recreational <br />pavilion will be collapsed and filled. The applicant proposes to construct a new individual <br />wastewater treatment system for the proposed single-family resort dwelling and caretaker's <br />quarters which meet the requirements of the State Department of Health. Plans and <br />specifications will be submitted to the State Department of Health for approval prior to the <br />construction of this new system. <br />9. Water Service. Existing water to the parcel is provided under a private <br />water agreement. The Trustees of the Richard Smart Revocable Personal Trust dba Parker <br />Ranch ("Smart Trust") and the applicant, John W. Hoffee, II, as Trustee of the John W. <br />Hoffee II Declaration of Trust Dated April 5, 1993, entered into an Assignment of Agreement <br />for Sale of Water, dated October 18, 1995. The Smart Trust conveyed all of its right, title and <br />interest in and to the Agreement for the Sale of Water ("Agreement") for the distribution of <br />water to the subject property by the Waikoloa Resort Utilities, Inc. ("WRU"). Under the <br />terms of the Agreement, WRU would initially distribute a maximum of 30,000 gallons of <br />water per month, to be increased to an amount not to exceed 90,000 gallons per month in <br />order to serve a maximum of four single family dwelling units and auxiliary uses (i.e., <br />irrigation and landscaping). The Agreement is effective for an initial term of five year and <br />will be automatically renewed year to year thereafter.
