Re: First Amendment of Lease
Enclosed is a resolution authorizing the County of Hawaii Mass Transit Agency to enter into a
First Amendment of the current lease, for a two year extension, at the Hilo Ironworks Building
located at tax map key (3) 2-2-001:030. The extension spans from July 1, 2014 through June 30,
2016, with the total monthly rent not to exceed $3,273.83.

A. REQUEST:
Prepare County Council submittal authorizing the County of Hawaii Mass Transit Agency to enter into a First
Amendment of Lease for a two year extension of the lease at the Hilo Ironworks Building.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The County of Hawaii Mass Transit Agency currently occupies approximately 1,600 square feet of office
space at the Hilo Ironworks Building located at tax map key (3) 2-2-001:030 portion. The lease amendment
is for a two year period from July 1, 2014 to June 30, 2016. The Mass Transit agency provides island-wide
public transportation for Hawaii County. Services operate daily with limited services on Sundays and
holidays. The agency also provides administrative support to the Hawaii County Transportation Commission
and oversees taxicab operators for Hawaii Island. The Mass Tansit agency wishes to extend the lease for
two years while it pursues the establishment of a permanent baseyard location.

FIRST AMENEDED LEASE
THIS FIRST AMENDED LEASE, made this_day of , 2014, by and
between MARTIN ANDERSON, and NORMAN PIIANAIA, Individuals, and KAPOHO
PROPERTIES, INC., and YAMANAKA ENTERPRISES, INC., Hawaii Corporations,
whose principal place of business and post office address is 1266 Kamehameha Avenue, Hilo,
Hawaii 96720, hereinafter collectively called"Managing Agent" or"Agent", and the COUNTY
OF HAWAII, a Municipal Corporation of the State of Hawaii,whose principal place of
business and post office address is 25 Aupuni St., Hilo, Hawaii 96720, hereinafter called
"County".
WITNESSETH:
A. By Lease dated June 25, 2013, Agent demised and leased to the County those certain
premises known as Unit A-2, Phase I of the Hilo Iron Works Building, Tax Map Key
(3) 2-2-001-030.
B. Agent and County desire to extend the term of the Lease upon the terms and conditions
hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual covenants and agreements
herein contained and other good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, Agent and County covenant and agree as follows:
1. The term of the Lease shall be amended to provide a two year extension of
term starting July 1, 2014 and ending June 30, 2016.
2. Effective July, 1, 2014 the Rent and CAM shall be follows:

3. Except as expressly modified and amended by this instrument, all other
terms and conditions of the Lease dated June 25, 2013, shall remain in full
