E-4039, SITUATE AT WAIAKEA, <br /> SOUTH HILO, ISLAND OF HAWAII, HAWAII, BEING A PORTION OF TAX MAP KEY: <br /> (3) 2-4-056:030 (POR.) FROM WAIAKEA UKA BIBLE CHURCH, A HAWAII NONPROFIT <br /> CORPORATION. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Waiakea Uka Bible Church, a Hawai`i nonprofit corporation is the owner of <br /> Road Lot B-2A needed for the Kapi`olani Street Extension, Job No. E-4039, situated at Waiakea, <br /> South Hilo, Island of Hawai`i, Hawai`i, identified as Tax Map Key: (3) 2-4-056:030 (por.), consisting <br /> of approximately plus or minus 431 square feet delineated on Exhibit "1" and described in Exhibit "2" <br /> attached hereto; and <br /> WHEREAS,the County of Hawai`i is proceeding with Kapi`olani Street Extension, Lanikaula <br /> Street to Mohouli Street. In order to complete the project, the County of Hawai`i needs to acquire this <br /> 431 square feet road lot; and <br /> WHEREAS, Waiakea Uka Bible Church, a Hawai`i nonprofit corporation is desirous of <br /> dedicating the above road lot, to the County of Hawai`i for roadway purposes, and to enhance <br /> vehicular, pedestrian, ADA and bicycle circulation between the University of Hawai`i at Hilo and <br /> downtown Hilo. The County's construction of this section of Kapi`olani Street will further advance <br /> the University of Hawai`i at Hilo's efforts to develop additional housing and support facilities in the <br /> immediate area; and <br /> WHEREAS, such dedication has been approved by the Planning Department, Department of <br /> Public Works, Department of Water Supply and the Department of Environmental Management; and <br /> WHEREAS, the subject road improvements have been completed according to County of <br /> Hawai`i standards, and are in acceptable condition for dedication, and in full compliance with the <br /> provisions of Chapter 23 of the Hawai`i County Code; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the <br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance <br /> with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii <br />
