COUNTY OF HAWAII :•1K'=°-•A •' STATE OF HAWAII ,•••�.-7TE F•N►� RESOLUTION NO. 457 14 RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR SEWER LINE PURPOSES AT POUPOUWELA AND KAWALA, KA`U, ISLAND OF HAWAII, HAWAII BEING A PORTION OF LOT 175 OF THE NA'ALEHU SUBDIVISION, THIRD SERIES TAX MAP KEY: (3) 9-5-024:009 TO THE COUNTY OF HAWAII. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, Dale Ann Andrade and Merle Chun, are the owners of real property situate at Poupouwela and Kawala, Ka`u, Island of Hawai`i, Hawai`i, being a portion of Lot 175 of the Na`alehu Subdivision, Third Series identified as Tax Map Key: (3) 9-5-024:009; and WHEREAS, a federal mandate requires that the County of Hawai`i close the existing County-owned large capacity cesspool currently serving the Na`alehu community; and WHEREAS, the County of Hawai`i, Department of Environmental Management is proceeding with the Na`alehu Collection System Project to replace the current existing sewer system with a new wastewater treatment plant which includes new collection lines for the treatment and disposal of sewage; and WHEREAS, Dale Ann Andrade and Merle Chun agree to grant an easement, on a portion of Lot 175 at no cost to the County of Hawai`i, Easement S-1, containing an area of 1,008 square feet, more or less, as described in Exhibit A and delineated on Exhibit B attached hereto, that authorizes, allows and permits the County of Hawai`i to construct, utilize and maintain the installed sewer line on their property, for public purpose; WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the Council, on behalf of the County of Hawai`i, may accept gifts or donations of real property; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of 1
