Yoshimoto, Chair and Members of the Hawai'i County Council o- 25 Aupuni Street Hilo, HI 96720 Subject: Resolution for a Sign Variance i Kona Hospitality LLC 75-146 Sarona Road Kailua Kona, HI 96740 TMK: 7-5-007:009 Zone: CG-20 (2.39 ac) Pursuant to Hawaii County Code (HCC) Sec. 3-22(a), I am forwarding Kona Hospitality LLC completed application for a sign variance. Kona Hospitality LLC is owner of the property. The contact person is Chanel Tsang of Ina Custom Signs whose phone number is (808) 935-4491. The applicant is requesting a sign variance for three wall signs. The first proposed wall sign, facing Sarona Road, is forty-three (43) square feet in area, which includes lettering not to exceed seventeen inches (17") high with a forty-nine inch (49") high monogram symbol. The second proposed wall sign, facing east, is less than sixteen (16) square feet in area, which includes lettering not to exceed seven inches (7") high with a thirty-four inch (34") high monogram symbol. These wall signs are to be mounted no higher than nine feet (9'-0") above the second and third floor levels respectively. The ground sign along Sarona Road is eighteen (18) square feet in area, which includes lettering not to exceed seven inches (7") high with a thirty-six inch (36") high monogram symbol. The sign will be mounted on a lava rock base at six feet (6'-0") above finish grade. The business is located in Kailua Village Core which limits the signs to twelve (12) square feet in area per section 3-58(b), Chapter 3, Hawaii County Code. The maximum allowable letter and/or symbol is nine inches (9") per section 3-58(c), Chapter 3, Hawaii County Code. The maximum number of signs allowed for any business, street, or (*to Comm. Lee, P. E., Director Department of Public Works County of Hawai`i Dear Mr. Lee: SUBJECT: Kailua Village Design Commission Meeting of May 6, 2014 Applicant: Ina Custom Signs Land Owner: Kona Hospitality LLC Design Review of a sign variance for two wall signs and a ground sign Tax Map Key: 7-5-007:009 (COR-14-091207) This letter is to inform you that the Kailua Village Design Commission, at its May 6, 2014 meeting, voted to recommend to the Public Works Director that the three signs proposed in the subject variance application be revised as to their size or placement as set forth below prior to your referral of this application to the County Council for its consideration: 1. The proposed mauka wall sign (facing Kuakini Highway) should be reduced in size to a maximum of sixteen (16) square feet and be comprised of only the Holiday Inn Express logo, that being the white "H" on the green square background as shown in the application. This would result in a sign area of approximately one-half of that proposed for this sign. 2. Placement of the proposed wall sign facing Sarona Road should be relocated to a lower elevation, directly below the proposed location, to be at the middle of the second floor elevation, in order to ensure long-term visibility under mature tree canopies and minimize unnecessary light projection beyond the necessary street exposures. 3. The size, shape and materials of the proposed ground sign should be revised as follows: a. The size of the ground sign should be reduced to comprise a maximum sign area of eighteen (18) square feet if the revised sign includes both logo and lettering, or a maximum of sixteen (16) square feet if it includes only a logo and background color as described in Recommendation No. 1 above. The Commission encouraged the applicant to consider repeating the same sign, in size, form and content, as recommended above for the mauka building wall (Recommendation No. 1). b. Rather than being mounted on a pedestal, the sign, whether single or double-sided, should be framed within a surrounding lava rock structure consistent with the appearance of lava rock walls in Kailua Village Hawaii county is an Equal Opportunity Provider and Employer 1 4: ,0.2.'h1 7:. Mr. Warren H.W. Lee, P. E., Director Department of Public Works May 13, 2014 Page 2 Although not a sign variance application matter, the Commission also requested the applicant to cause the landowner/hotel operator to remove or reconstruct the existing cinder-block enclosure fronting Sarona Road out of lava rock to blend with other walls in this community. In doing so I hope to help clarify the reasons we are submitting for the variance. 1. The county allows only one sign per business or per street frontage. The brand approved design requires 3 signs total, two of which face Sarona Road. 2. The county allows walls signs to be a maximum of 12 square feet. The brand approved signs are as follows: sign #1 = 43 square feet,sign#2 = 32 square feet, sign #3 = 18 square feet. 3. The county allows lettering and symbols to be a maximum height of 9 inches The monogram for all three of our signs exceeds this,as does the letters at our sign #1,as required by the brand approved design. Intercontinental Hotel Groups(IHG),the franchise which represents the Holiday Inn Express brand, has very specific standards which we must meet in order to operate under the Holiday Inn Express flag.Among these standards are criteria that relate to the size and configuration of exterior signs. Because these standards conflict with the county's codes and regulations, and because the building needs to be easily identified by tourists from a distance,we are submitting the aforementioned variance application. The request to install a standalone "H" monogram is denied for the following two reasons: Denial Reason #1: Holiday Inn Express Brand Standards strictly prohibit the use of a standalone "H" monogram on any exterior signage. Brand Standards require the use of the Federally Registered Trademark that includes the Holiday Inn Express lettering. Installing a standalone "H" monogram sign as proposed by the County of Hawaii is a violation of Brand Standards. Denial Reason #2: The Holiday Inn Express logo is a registered trademark with the US Patent and Trademark Office. Hotels are required to provide exterior signage that is compliant with the registered marks. The Holiday Inn Express logo that is registered with the US Patent and Trademark Office contains the H monogram on a green background and Holiday Inn Express word marks on a Blue background. Please refer to the enclosed registration document for verification of the registration. Failure to install acceptable signage that is compliant with both IHG Brand Standards and compliant with our federally registered trademarks will result in the hotel being placed in to Default of the Hotel's License Agreement. Failure to cure a Default of the Hotel's License Agreement may result in the hotel being terminated from the IHG System if the Default status is not cured within the timelines provided by IHG. The IHG franchise(Six Continents Hotels Group,Inc.)that represents Holiday Inn Express is not allowing us to use a single monogram"H" logo to stand alone without the Holiday Inn Express copy and blue panel beside it,because the"H" logo with"Holiday Inn Express" locked together is the registered trademark signage for Holiday Inn Express.
