Pursuant to Hawaii County Code (HCC) Sec. 3-22(a), I am forwarding Scanlan
Management LLC completed application for a sign variance. The owner of the property
is Relo Kona, LLC and the contact person is Raini Castro of John Allen Sign Company
whose phone number is (808) 882-8244. The applicant is requesting a sign variance for
three wall signs. The proposed sign is twenty-two (22) square feet in area with nine
inches (9") high lettering with a twenty-eight inch (28") high symbol. Two of the signs are
mounted at nine feet (9'-0") above finish grade. The third sign is mounted at twenty feet
(20'-0") above finish grade. The maximum allowable letter and/or symbol is nine inches
(9") per section 3-58(c) Chapter 3, Hawaii County Code. The business is located in CG-
20 zone which limits the wall sign to nine feet (9'-0") in height per section 3-59(a)(4)
Chapter 3, Hawaii County Code.

Sign Permit and Sign Variance Application Submittal Requirements: Submit this checklist when filing

A variance is being requested for signage located at the Jack in the Box located at 75-934
Henry Street, Kailua Kona,HI,96740(TMK 7-5-004-0031-0000).
The variance Is for:
- 'Jack' Lettering/Symbol on all three(3)proposed signs.The red box symbol with the
'Jack' lettering exceeds 9" reference Section 3-58(c).
- Sign A3 elevation. Referencing Section 3-59(a)(4).
The distance from public viewing to the sign would benefit from taller lettering to gain more
exposure and accomplish the sign's purpose for advertising as well as keeping consistent with
the proportions of their corporate logo.

A2, and A3. The lettering "in the box" on each sign type,Al,A2, and A3,will not
exceed nine inches in height.

To whom it may concern:
Please use this letter as a written statement to verify that the Jack in the Box
signage as shown in DWG# 12-958 adheres to county sign code Section 3-58
(c), referencing sign lettering height and restriction of symbols.
As noted on page 2 of 6 on the submitted sign package, signs Al &A2 comply
with the counties restriction of letter heights not exceeding 9" in overall height.
The adjustment has been made on the sign package to ensure that the letter
height is appropriately reflected. The county also had a concern that the "red box"
shape part of the sign was not a symbol, as attached in an additional exhibit to
this letter, reference has been provided to show that the JIB logo is indeed a
registered trademark with the United States Patent and Trademark Office, and as
such we do not have the ability to alter this logo in any capacity. A3 shown on
page 3 of 6 has also been adjusted to properly reflect the letter height restriction
as set for by county sign code.
