The decision of <br /> the Supreme Co rt is still pending. <br /> Thereafte , in order to adquately preserve our rights previously <br /> established in th LUC proceedings, Ka Pa'akai 0 Ka `Aina also intervened <br /> in the County of Hawaii Planning Commission's SMA proceeding on the <br /> application of K 'upulehu Developments. Following a contested case <br /> hearing the Platming Commission granted the SMA permit on December <br /> 11, 1998. <br /> The matte is now before this body for a zoning measure. In that <br /> regard Ka Pa'akai 0 Ka 'Aina directs this council to the Decision rendered <br /> on December 21, 1998 in Civil No. 97.028K, Third Circuit Court Regarding <br /> "Sunshine Law" Violations.
