REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> REGARDING: Communication No. 939/Bill No. 267 <br /> DATE: July 17, 2014 <br /> LOCATION: Council Chambers, Kona, Hawai`i <br /> TITLE: AN ORDINANCE AMENDING THE STATE LAND USE BOUNDARIES <br /> MAPS FOR THE COUNTY OF HAWAII BY CHANGING THE DISTRICT <br /> CLASSIFICATION FROM THE AGRICULTURAL TO THE URBAN <br /> DISTRICT AT KAMA`OA, KA`U, HAWAII (TMK: 9-2-093:039, 040, 041 & <br /> 042). <br /> EXPLANATION: Bill No. 267 had been transmitted by Mayor William P. Kenoi, via <br /> Communication No. 939, dated June 18, 2014. The area covers 4.143 acres. The <br /> applicant is Dr. William C. Foulk. <br /> There were testifiers present in Kona(1), Hilo (1), and Ka`u (7) in support of Bill. <br /> The developer was also present to provide comment and answer questions by <br /> Committee Members. <br /> Committee members expressed a desperate need for a commercial center in the <br /> area affected. Committee members also expressed concerns regarding the usage <br /> of a private road and the process of setting up a proper water system. The <br /> developer responded that Lehua Court will gladly contribute funds to get private <br /> road up to County standards. He understands there is a possibility that even if the <br /> road is up to County standards, the County may not accept dedication. Council <br /> Member Ford sought clarity with Corporation Counsel regarding this concern. <br /> According to Corporation Counsel, it is ultimately at the Council's discretion as it <br /> would need to be voted on at Council level. <br /> In regards to the water system concerns, according to the developer, the Dept. of <br /> Water Supply remains autonomous and has not agreed to do a commercial meter <br /> for the development proposed.
