As amended hereby, Resolution No. 264-14 is in all respects ratified, confirmed and reaffirmed, and <br /> such Resolution as so amended hereby shall be read, taken and construed as one and the same <br /> instrument. <br /> 3. Public Hearing. In addition to the public hearing held pursuant to Resolution No. <br /> 264-14, a further combination hearing shall be held with respect to the Improvement District, <br /> including the Revised Assessment Roll, pursuant to Section 12-28. Such hearing shall be held not <br /> more than sixty (60) days after the adoption of this resolution and not less than fifteen (15) days <br /> after the first publication thereof in at least one newspaper of general circulation in the County of <br /> Hawai`i. Copies of the notice shall also be posted at a public place in the district in which the <br /> proposed Improvement District is located at least ten (10) days prior to the public hearing. The <br /> County Clerk shall assure that affidavits of publication and posting o f the notice shall be filed with <br /> the Council on or before the date of the hearing. <br /> 4. Protests by Property Owners. At or prior to the further public hearing to be held, the <br /> owners of any assessment units may file with the Council written protests, objections or suggestions <br /> regarding the proposed Improvements as provided in Section 12-12 of the Hawai`i County Code. If <br /> the owners of assessment units having fifty percent (50%) or more of the total assessments, based <br /> on SFEs, file written protests, duly acknowledged by such owners, against making all or part of the <br /> proposed Improvements or against the methods by which such assessments are to be made, or the <br /> inclusion of certain costs therein, then the Improvements or methods of assessment shall not be <br /> made contrary to said written protests. If the protest is against the making of any Improvement, the <br /> same shall not be made, and the proceedings shall not be renewed within six months from the date <br /> of closing the public hearing, unless all owners withdraw their protests. <br /> BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i shall <br /> transmit copies of this resolution to the Honorable Mayor William Kenoi; Finance Director <br /> Nancy Crawford; Corporation Counsel Molly Stebbins; Real Property Tax Division Tax <br /> Administrator Stanley Sitko; Department of Environmental Management Director Bobby Jean <br /> Leithead-Todd; Environmental Management Commission Chair Anne Lee; Hawai`i State <br /> Director Chris Kanazawa, USDA Rural Development; Bond Counsel Brian T. Hirai, <br /> McCorriston Miller Mukai MacKinnon LLP; and County Clerk Stewart Maeda. <br />
