COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />564 14 <br />RESOLUTION ACCEPTING THE GRANT OF EASEMENT D-2 FOR DRAINAGE AND <br />SLOPE PURPOSES NEEDED FOR THE KAPI`OLANI STREET EXTENSION, JOB <br />NO. E-4039, SITUATE AT WAIAKEA, SOUTH HILO, ISLAND OF HAWAII, HAWAII, <br />BEING A PORTION OF TAX MAP KEY: (3) 2-4-056:021 (POR.) FROM THE STATE OF <br />HAWAII, HAWAII PUBLIC HOUSING AUTHORITY. <br />WHEREAS, The State of Hawaii, Hawaii Public Housing Authority is the owner of <br />Lot A-1 needed for the Kapi`olani Street Extension, Job No. E-4039, situated at Waiakea, South Hilo, <br />Island of Hawaii, Hawaii, identified as Tax Map Key: (3) 2-4-056:021 (por.), as delineated on <br />Exhibit "1" attached hereto; and <br />WHEREAS, the County of Hawaii is proceeding with Kapi`olani Street Extension, Lanikaula <br />Street to Mohouli Street. In order to complete the project, the County of Hawaii needs to acquire the <br />easement for drainage and slope purposes, over and across 62 square feet portion of this lot; and <br />WHEREAS, The State of Hawaii, Hawaii Public Housing Authority is desirous of granting <br />the County of Hawaii the perpetual easement described in Exhibit "2" between the University of <br />Hawaii at Hilo and downtown Hilo. The County's construction of this section of Kapi`olani Street <br />will further advance the University of Hawaii at Hilo's efforts to develop additional housing and <br />support facilities in the immediate area; and <br />WHEREAS, such easement has been approved by the Planning Department, Department of <br />Public Works, Department of Water Supply and the Department of Environmental Management; and <br />WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving <br />by dedication any streets in any subdivision platted after December 2, 1966 except upon full <br />compliance with the provisions of Chapter 23; and <br />
