COUNTY OF HAWAII ORDINANCE NO. STATE OF HAWAII BILL NO. 15 AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, SECTION 24- 260, SCHEDULE 8 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO 45 MILE PER HOUR LIMIT. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. This amendment is being proposed based on a request to review and possibly revise the speed limits in this area of Kalapana-Kapoho Beach Road. A traffic study, which included a speed and volume count and an intersection and stopping sight distance review, justified the addition of a new 45 mph speed limit starting at Kapoho Kai Drive and extending in the southerly direction. SECTION 2. Chapter 24, Article 10, Division 1, Section 24-260, Schedule 8. 45 Mile Per Hour Speed Limit, paragraph (g) Puna is amended by adding new item and renumbering as required: ( ) Kalapana-Kapoho Beach Road from Kapoho Kai Drive and extending six thousand three hundred sixty-one feet in the southerly direction SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable.
