COUNTY OF HAWAII RESOLUTION NO. 107 STATE OF HAWAII 1S RESOLUTION ACCEPTING THE DEDICATION OF LOT E (ROAD), BEING A PORTION OF TAX MAP KEYS: (3) 6-2-001:075 (POR) AND (3) 6-2-015:041 SITUATE AT OULI, SOUTH KOHALA, ISLAND OF HAWAII FROM HALE WAILANI PARTNERS LP AND HAWAII ISLAND COMMUNITY DEVELOPMENT CORPORATION. WHEREAS, Hale Wailani Partners LP ("Hale Wailani") is the owner of a portion of Lot 4, (Road) Ouli Signal Subdivision, bearing Tax Map Key No. (3) 6-2-001:075(por) and Hawaii Island Community Development Corporation ("HICDC") is the owner of HICDC Lot 41, of the Ouli Mutual Self Help Housing Project Subdivision, identified as Tax Map Key: (3) 6-2-015:041, situate at Ouli, South Kohala, Island of Hawaii, as delineated on Exhibit "A" attached; and WHEREAS, Hale Wailani and HICDC simultaneously consolidated portions of said Hale Wailani Lot 4 (Road) with the HICDC Lot 41, to create Lot E (road); WHEREAS, Hale Wailani and HICDC have constructed all subdivision improvements and received final subdivision approval for Lot E (road); and WHEREAS, Hale Wailani and HICDC are desirous of dedicating Lot E (road), including all subdivision improvements thereon, to the County of Hawaii for roadway purposes, and the improvements have been inspected and approved by the County of Hawaii Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, the subject road improvements have been completed according to County of Hawaii standards, and are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawaii County Code to the extent applicable; and WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966 except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii.
