COUNTY OF HAWAII <br />RESOLUTION NO. 107 <br />STATE OF HAWAII <br />1S <br />RESOLUTION ACCEPTING THE DEDICATION OF LOT E (ROAD), BEING A PORTION <br />OF TAX MAP KEYS: (3) 6-2-001:075 (POR) AND (3) 6-2-015:041 SITUATE AT OULI, <br />SOUTH KOHALA, ISLAND OF HAWAII FROM HALE WAILANI PARTNERS LP AND <br />HAWAII ISLAND COMMUNITY DEVELOPMENT CORPORATION. <br />WHEREAS, Hale Wailani Partners LP ("Hale Wailani") is the owner of a portion of Lot 4, <br />(Road) Ouli Signal Subdivision, bearing Tax Map Key No. (3) 6-2-001:075(por) and Hawaii Island <br />Community Development Corporation ("HICDC") is the owner of HICDC Lot 41, of the Ouli Mutual <br />Self Help Housing Project Subdivision, identified as Tax Map Key: (3) 6-2-015:041, situate at Ouli, <br />South Kohala, Island of Hawaii, as delineated on Exhibit "A" attached; and <br />WHEREAS, Hale Wailani and HICDC simultaneously consolidated portions of said Hale <br />Wailani Lot 4 (Road) with the HICDC Lot 41, to create Lot E (road); <br />WHEREAS, Hale Wailani and HICDC have constructed all subdivision improvements and <br />received final subdivision approval for Lot E (road); and <br />WHEREAS, Hale Wailani and HICDC are desirous of dedicating Lot E (road), including all <br />subdivision improvements thereon, to the County of Hawaii for roadway purposes, and the <br />improvements have been inspected and approved by the County of Hawaii Department of Public <br />Works, and received dedication approval from the Department of Water Supply, Planning Department <br />and Department of Environmental Management; and <br />WHEREAS, the subject road improvements have been completed according to County of <br />Hawaii standards, and are in acceptable condition for dedication, and in full compliance with the <br />provisions of Chapter 23 of the Hawaii County Code to the extent applicable; and <br />WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving <br />by dedication any streets in any subdivision platted after December 2, 1966 except upon full <br />compliance with the provisions of Chapter 23; and <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br />council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. <br />
