STATE OF HAWAII 121 15 RESOLUTION ACCEPTING THE DEDICATION OF LOT 4 AND DRAINAGE EASEMENT, BEING TAX MAP KEY: (3) 6-7-002:063, SITUATE AT WAIKOLOA AND PU`UKAPU, SOUTH KOHALA, ISLAND OF HAWAII FROM PR MAUNA KEA LLC AND MICHAEL W. GIBSON, TIMOTHY E. JOHNS AND B. G. MOYNAHAN, AS SUCCESSOR TRUSTEES UNDER THAT CERTAIN UNRECORDED LAND TRUST AGREEMENT FOR THE PARKER LAND TRUST DATED SEPTEMBER 13, 2002. WHEREAS, PR Mauna Kea LLC ("PR Mauna Kea") and Michael W. Gibson, Timothy E. Johns and B. G. Moynahan, as Successor Trustees Under That Certain Unrecorded Land Trust Agreement for Parker Land Trust dated September 13, 2002 ("Parker Land Trust") are the owners of Lot 4 and drainage easement containing an area of 23.945 acres and 0.824 acres, respectively, identified as a Tax Map Key: (3) 6-7-002:063, situate at Waikoloa and Pu`ukapu, South Kohala, Island of Hawaii, as delineated on Exhibit A attached; and WHEREAS, Conditions G and M (1)0) Rezoning Ordinance No. 02-25, required land for a public park and recreational purposes; and WHEREAS, PR Mauna Kea and Parker Land Trust are desirous of dedicating Lot 4 and drainage easement, including all improvements thereon, to the County of Hawaii for public park and recreational purposes; and WHEREAS, pursuant to Hawaii County Code Section 2-162.1 the County of Hawaii Planning Department, Department of Public Works, Department of Parks and Recreation, Department of Water Supply, Department of Environmental Management have been consulted, performed necessary inspections, and recommend approval and acceptance of the dedication; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds that it is in the public interest to accept such dedication and easement as described herein. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 2-162.1 of the Hawaii County Code, that the County of Hawaii accepts the dedication of Lot 4 and drainage easement, identified as Tax Map Key: (3) 6-7-002:063, delineated on Exhibit A attached hereto, including all improvements thereon, for public park and recreational purposes. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) the Planning Department; (4) the Department of Parks and Recreation; (5) the Department of Water Supply; (6) the Department of Environmental Management; (7) Deputy Corporation Counsel J Yoshimoto; and (4) Steven S. C. Lim, Attorney at Law, Carlsmith, Ball LLP, 121 Waianuenue Avenue, Hilo, Hawaii 96720.
