Dru Kanuha, Council Chair <br />and Members of the County Council <br />Page 2 <br />The Commission concurs with the following Planning Director's reasons for recommending <br />favorable consideration of the request: <br />The applicant requests amendments to Condition B, C, D and H of Change of Zone <br />Ordinance No. 08 115, which amended Change of Zone Ordinance No. 93 36. The <br />specific amendments follow. Material to be deleted is bracketed; new material is <br />underscored. <br />Proposed Amendment to Condition B (water commitment payment): <br />B. The required water commitment payment for the remaining phases of <br />development shall be submitted to the Department of Water Supply in accordance <br />with its "Water Commitment Guidelines Policy" within 180 days from the [date <br />of approval of the amended change of zone] completion and acceptance of the <br />Pi`ihonua-Kukuau Transmission Line Project by the Department of Water Supply <br />and Water Board. The applicant shall pay installation and facilities charges as <br />required by the Department of Water Supply. <br />The applicant is requesting to amend Condition B (water commitment payment) to <br />change the timing of payment of water commitment fees for the remaining phases of <br />development until after the Pi`ihonua-Kukuau Transmission Line Project is completed. <br />This water transmission line project is needed in order to provide water to the site for <br />development of the remaining phases. The condition currently requires payment of the <br />water commitment fees within 180 days from the effective date of Change of Zone <br />Ordinance 08 115. <br />Proposed Amendment to Condition C (time extension to secure Final Subdivision <br />Approval for remaining phases and deletion of a construction bond to construct the <br />Kupulau Street extension): <br />C. Final Subdivision Approval for the remaining phases of the development shall be <br />secured within five (5) years from the completion and acceptance of the <br />Pi`ihonua-Kukuau Transmission Line project by the County Department of Water <br />Supply and Water Board or ten (10) years from the effective date of this <br />amendment, [provided further, that for the construction of the Kupulau Street <br />extension, final subdivision approval shall be granted upon the developer posting <br />a construction bond of $3.5 million, after it has been determined by the Planning <br />Director, in consultation with the Department of Public Works, that the <br />
