Curtis Tyler, III, Councilmember <br /> Hawaii County Council <br /> RE: Reonelehua Heights Project <br /> Pursuant to our January 31 meeting in your office regarding the <br /> referenced project, I would like some clarification of the <br /> department's position on the pre-emptions being proposed by <br /> Nohona Partners under HRS 201E-210. <br /> The Council is being asked to approve three pre-emptions from <br /> the zoning and subdivision codes for the proposed project. As <br /> part of my evaluation of the effect such pre-emptions might <br /> have on residents and the general public, I need to know the <br /> following: - <br /> 1. Has your department reviewed the proposed <br /> pre-emptions? <br /> 2. If so, what effects will these pre-emptions have on <br /> the department's existing standards for any improvements <br /> normally required for a development of this size? <br /> 3. If any standards will be changed by these <br /> pre-emptions, what effect will such changes have on the issues <br /> of public health, safety, and welfare? <br /> 4. Will the County (i.e. taxpayers) be exposed to any <br /> additional liability if any or all of these are approvedT <br /> 5. if so, will your department be willing to endorse <br /> these pre-emptions inspite of these? <br /> <br />
