RIYOSARI, CHIEF ENGINEE <br /> SUBJECT: REONELEHUA HEIGHTS PROJECTS <br /> The following are responses to your memo of February 5, 1997. <br /> 1. Has your department reviewed the proposed pre-emptions? <br /> Yes. <br /> 2. If so, what effects will these pre-emptions have oa the <br /> department's ezisting standards for any improvements normally <br /> required for a development of this sine and the conditions already <br /> imposed by the previously approved documents noted above? <br /> These pre-emptions are in accordance with HRS 201E-210 which deals <br /> with affordable housing projects only. Therefore, this will have <br /> no effect on normal subdivision standards. The pre-emptions for <br /> affordable housing projects are decided on a case-by-case basis. <br /> 3. If any standards will be changed by these pre-emptions, what <br /> effect will such changes have oa the issues of public health, <br /> safety, and welfare? <br /> These pre-emptions, as required by law, meet minimum requirements <br /> of health and safety. <br /> 4. Will the County (ie. tazpayers) be ezposed to any additional <br /> liability, if any, if all of these are approved? <br /> While this matter should be referred to the Corporation Counsel, in <br /> accordance with HRS 201E-210, "NO action shall be prosecuted or <br /> maintained against any county, its officials, or employees, on <br /> account of actions taken by them in reviewing, approving or <br /> disapproving the plans and specifications." <br /> 5. If so, will your department be willing to endorse these <br /> pre-emptions inspite of these? <br /> Our department's responsibilities are to review the construction <br /> plans for minimum requirements of health and safety. These plans <br /> are consistent with these requirements. <br /> For your additional information, all roads in this subdivision will <br /> remain under private ownership. O / <br /> iomrn.
