No. 234/Bill No. 40 <br /> PLACE: Council Chambers <br /> Kona, Hawai`i <br /> TIME: 12:00 p.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i 96720 <br /> Your Committee on Public Works and Parks and Recreation,to which was referred Bill No. 40, <br /> reports as follows: <br /> Bill No. 40, transmitted by Council Chair Dru Mamo Kanuha, via Communication No. 234 dated <br /> March 24, 2015, amends Chapter 15, Article 2 and 3, of the Hawai`i County Code 1983 <br /> (2005 Edition, as amended), relating to Parks and Recreation. <br /> The bill amends various sections to expand and more clearly define first amendment protections for <br /> solicitation-related activity at County parks and recreational facilities. <br /> Council Chair Kanuha, who is in support of Bill No. 40, clarified to the Council that this bill was <br /> introduced by Corporation Counsel and not"By Request". He stated that the intent of the proposed <br /> amendments to Chapter 15, of the Hawai`i County Code,related to solicitation-related activity at <br /> County parks, is to be consistent with the First Amendment of the Constitution. Mr. Kanuha further <br /> added that the Corporation Counsel drafted the amendments in conjunction with the American Civil <br /> Liberties Union (ACLU). <br /> During the meeting, Bill No. 40 was amended with the contents of Communication No. 234.1, <br /> transmitted by Council Chair Kanuha, dated April 14, 2015. <br /> Corporation Counsel Molly Stebbins appeared before Your Committee for questions.
