FC -9 <br />May 5, 2015 <br />Bill 37: AMENDS CHAPTER 2, ARTICLE 15, OF THE HAWAII COUNTY CODE 1983 <br />(2005 EDITION, AS AMENDED), RELATING TO THE CODE OF ETHICS <br />Amends: 1) Definitions — revises definition for "agency" and adds definition for <br />"immediate family"; 2) Fair Treatment — Adds provision for use of County property <br />for County of Hawaii workers' union meetings and adds provision requiring Council <br />approval (two-thirds vote) for any County contract for goods and services with a <br />County officer or employee or a business where an immediate family member of a <br />County officer or employee has a controlling interest of said business; 3) Conflicts of <br />Interest — revises provisions for the ability of County officers and employees to represent <br />private interests in legal actions/proceedings against the County or appear on behalf of <br />private interests before any agency of the County; and 4) Contracts — revises provisions <br />for County agencies to enter into contracts when the value of the service or property <br />exceeds $10,000 by removing existing exceptions allowed per the State Public <br />Procurement Code and replacing with a provision that allows for such a contract if the <br />Council approves by two-thirds vote. <br />Reference: Comm. 231 <br />Intr. by: Ms. Wille <br />Postponed: April 14, 2015 <br />(Note: There is a pending motion by Ms. Wille and duly seconded by Mr. Kanuha <br />to recommend passage of Bill 37 on first reading.) <br />; and <br />Comm. 231.1: From Council Member Margaret Wille, dated April 17, 2015, requesting that Bill 37 be <br />placed on the May 5, 2015, Finance Committee agenda. <br />ADJOURNMENT <br />Note: B/R, when listed next to the name of an Introducer, signifies that the Council Member has agreed <br />to introduce legislation `By Request" on behalf of the requesting party.
