C <br />5. 3400 21' 30.40 feet along the remainder of Grant 4834 to <br />Kahoohanohano; <br />6. Thence along the remainder of Grant 4834 to Kahoohanohano, on a curve to the <br />right with a radius of 30.00 feet, the <br />chord azimuth and distance being: <br />25° 21' 42.43 feet; <br />7. 3400 21' 10.00 feet along the remainder of Grant 4834 to <br />Kahoohanohano; <br />8. 700 21' 161.86 feet along the Northerly side of Mamalahoa <br />Highway to the point of beginning and <br />containing an area of 1.166 Acres. <br />All as shown on the map attached hereto, marked Exhibit "A" and by reference <br />made a part hereof. <br />SECTION 2. These changes in district classification are conditioned upon the following: <br />A. The petitioner, its successors or assigns, shall be responsible for complying with <br />all conditions of the change of zone. <br />B. The required water commitment payment shall be submitted to the Department <br />of Water Supply in accordance with its "Water Commitment Guidelines Policy" <br />within ninety (90) days from the effective date of the change of zone ordinance. <br />C. Final Subdivision Approval shall be secured within five (5) years from the <br />effective date of this ordinance. <br />D. Prior to commencing construction in the Village Commercial zoned area, Final <br />Plan Approval for the proposed commercial development shall be secured from <br />the Planning Director in accordance with Chapter 25-2-70 of the Zoning Code. <br />Plans shall identify the proposed structures, vehicular traffic, paved driveway <br />access and parking stalls associated with the proposed use.
