No. 475/Res.No. 286-15 <br /> PLACE: Council Chambers <br /> Hilo, Hawai`i <br /> TIME: 10:50 a.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Finance, to which was referred Resolution No. 286-15, reports as follows: <br /> Resolution No. 286-15, transmitted by Finance Director Deanna S. Sako, via Communication <br /> No. 475 dated September 10, 2015, authorizes the addition and increase of basic fees in the Rules and <br /> Regulations of the Liquor Commission of the Department of Liquor Control of the County of <br /> Hawaii, State of Hawai`i. <br /> The Rules would be amended to add basic license fees for Condominium Hotel ($1,200), Winery <br /> ($1,000), and Small Craft Producer Pub ($1,000); and to increase license fees for Caterer from $120 <br /> to $600. <br /> Liquor Control Director Gerald Takase came forward and explained that fee setting and fee increases <br /> must come before council pursuant to Hawaii Revised Statutes and that new classes are created by <br /> the State Legislature. <br /> Several council members made inquiries and expressed concerns, to which Mr. Takase responded <br /> with clarification. <br /> Pursuant to Sections 281-17(a)(4) of the Hawaii Revised Statutes, rules, when adopted as provided <br /> in chapter 91 shall have the force and effect of law. <br /> Pursuant to Section 281-17.5(c) of the Hawai`i Revised Statutes, any increase in the liquor license fee <br /> structure shall only be initiated by the liquor commission seeking the change with the approval of the <br /> county's legislative body and mayor. <br /> Your Committee on Finance is in accord with the purpose and intent of Resolution No. 286-15, and <br /> recommends its adoption. <br /> wb <br /> AYES NOES ABS EX Respectfully submitted, <br /> CHUNG X <br /> DAVID X COMMITTEE ON FINANCE <br /> EOFF X <br /> ILAGAN X <br /> KANUHA X <br /> ONISHI X yt/ <br /> PALEKA x KAREN EOFF, CHA <br /> POINDEXTER x FC REPORT NO.: 36 <br /> WILLE x ADOPTED: OCT 2 0 2015 <br />
