The property is located on the southeast(Puna-makai) corner of the Kino`ole and Lono Streets intersection in Waiakea House Lots, Waiakea, South Hilo, Hawai`i. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the request: The applicants request a 5-year time extension to comply with Condition E of Change of Zone Ordinance No. 94 06, which states: "Construction of the proposed commercial development shall be completed within three (3) years from the effective date of this ordinance." In 1996, the Planning Director issued an administrative time extension until January 26, 2000 to complete construction. The applicants are requesting a 5-year time extension from the date of approval of this proposed amendment to complete construction of a medical office building or other commercial development. They have been unable to proceed with construction of the project due to unforeseen personal health issues and the recent recession. However, they are committed to completing construction of an office building to accommodate a dental laboratory and financial services office for the applicants, businesses that they currently conduct in other locations in Hilo, and other commercial opportunities. The non-performance is the result of conditions that could not have been foreseen or are beyond the control of the applicant, successors or assigns, and that are not the result or their fault or negligence. Conditions of the change of zone ordinance required that the applicants secure water commitments from the Department of Water Supply(DWS) and secure Final Plan Approval for the proposed commercial development from the Planning Director. It does not appear that water commitments have been secured to date, however in their memo dated July 31, 2015 the DWS indicated that County water is still available for the proposed development. Additionally, in 1995 the applicants secured Final Plan Approval for an approximately 13,000-square foot office building and related improvements. In 2006, the existing dwelling was demolished in anticipation of developing the property. The applicants have been unable to complete development of the property due to unforeseen personal health issues that affected their ability to market the property and the recent recession which limited their ability to secure financing. However, the applicants remain committed to completing the commercial development as evidenced by their continued ownership of the property for over 20 years. Thus, the applicants have been working towards compliance with the conditions of the change of zone and non-performance is the result of conditions that could not have been foreseen and were beyond the control of the applicant. Approval of this request would not be contrary to the General Plan or Zoning Code nor the original reasons for granting the Change of Zone. There have not been any significant changes to the General Plan for this area since the rezone was approved in 1994. At that time the General Plan LUPAG Map designation for the Dru Kanuha, Council Chair and Members of the County Council Page 3 property was the same that it is today, High Density Urban. This designation allows for general commercial, multiple family residential (up to a density of 87 units per acre), and related services, thus the current General Commercial (CG) zoning is consistent with the General Plan designation. A comprehensive change was made to the Zoning Code in 1996, two years after the rezone was approved. Plan Approval No. 2987, which was issued in 1995, included reduced off-street parking, minimum yards, and landscaping requirements than the current Zoning Code. For example, there was no minimum side yard requirement for the property in 1994, whereas today the minimum side yard requirement is 15 feet. The off- street parking requirement also increased from 1 parking stall per 400 square feet of gross floor area to 1 parking stall per 300 square feet of gross floor area. Additionally, in 2008 the County Council adopted concurrency requirements in the Zoning Code which will require that the applicant complete a traffic impact analysis report and mitigate any adverse impact prior to developing the property. Based on these significant changes in the Zoning Code since the rezone was originally granted, the Planning Director has invalidated the original Plan Approval No. 2987, and will require the applicants secure a new Plan Approval for the proposed commercial development based upon the current Zoning Code. The Department of Public Works (DPW)has recommended that in addition to the current conditions of approval related to frontage improvements to Lono Street, the applicant install a full width concrete sidewalk along the property's Kino`ole Street frontage. There are currently curb, gutter and sidewalk improvements along the property's Kino`ole Street frontage,but the sidewalk has only 4-foot wide pavement and 6-foot wide grass rather than the standard 10-foot wide paved sidewalk recommended by DPW. With the addition of a condition to address DPW's recommendation, the amendment request will not unreasonably burden public agencies to provide infrastructure and utilities to the property. This favorable recommendation is made with the understanding that the applicant remains responsible for complying with all other applicable governmental requirements in connection with uses permitted within the General Commercial zoning district, prior to its commencement or establishment upon the subject property. Additional governmental requirements may include the issuance of building permits, compliance with the Fire Code, installation of improvements required by the American with Disabilities Act Dru Kanuha, Council Chair and Members of the County Council Page 4 (ADA), among many others. Compliance with all applicable governmental requirements is a condition of this favorable recommendation; failure to comply with such requirements will be considered a violation that may result in enforcement action by the Planning Department and/or the affected agencies. Based on the above findings, the Planning Director recommends that a favorable recommendation be forwarded to the County Council to amend Ordinance No. 94 06. In addition, the Planning Director recommends that existing conditions in the ordinance be revised to reflect the current standard language for conditions of approval. The accompanying draft bill to amend Ordinance No. 94 06 is provided for your favorable consideration. Please note the proposed conditions of approval attached to the draft bill. Supportive Information: The applicants, who are the landowners, have submitted the attached in support of the request: (Planning Department Exhibit 1 —Letter from Eric Hoota dated June 30, 2015 requesting a time extension) Re: Bill 109/Conn. 524 -1- BACKGROUND INFORMATION 4. January 26, 1994: Effective date of Ordinance No. 94 06, which rezoned approximately 26,770 square feet of land from Single-Family Residential-10,000 square feet(RS-10)to General Commercial-10,000 square feet (CG-10). (P.D. Exhibit 2- Ordinance No. 94 06) 5. February 15, 1995: Final Plan Approval issued by the Planning Director for an approximately 13,000-square foot office building and related improvements. Section 25- 2-7 of the Zoning Code states that whenever an approval, such as a Final Plan Approval, has not been utilized within two years from the date of approval, the Director shall initiate proceedings to invalidate the approval. Since the Final Plan Approval for the proposed development was issued 20 years ago and significant changes were made to the Zoning Code since this approval was issued, this report serves as notice that the Director will invalidate the approval and require a new Plan Approval for commercial development of the property. October 30, 1996: The Planning Director issued a 3-year administrative time extension until January 26, 2000 for the applicants to complete construction. (P.D. Exhibit 4- October 30, 1996 Planning Department letter) 7. November 9,2006: Building Permit No. B2006-2943H was issued to the applicants for the demolition of an existing dwelling on the property. STATE AND COUNTY PLANS 8. State Land Use Designation: Urban. 9. General Plan LUPAG Map: High Density Urban. 10. County Zoning: General Commercial- 10,000 square foot minimum lot size(CG-10). 11. Hilo Community Development Plan: The Hilo Community Development Plan adopted by Planning Commission Resolution No. 1 on May 21, 1975 suggests a Multiple-Family Residential-4,000 square feet (RM-4) zoning district for this area. DESCRIPTION OF PROPERTY AND SURROUNDING AREA 12. Subject Property: The property is rectangular shaped and the topography is relatively level. A single-family dwelling that was built on the property around 1962 was demolished in 2006. The property is currently vacant of structures except for a fence around the property boundaries. -2- 13. Surrounding Zoning/Land Uses: Surrounding properties are zoned Single-Family Residential— 10,000 square feet(RS-10) and primarily in residential use. The property to the north across Lono Street is zoned General Commercial—20,000 square feet(CG-20) and is the site of a credit union. The property to the northwest across the intersection is zoned Neighborhood Commercial— 10,000 square feet(CN-10) and is developed as a medical office. 14. Flood Zone: Zone"X", an area determined by FEMA to be outside the 500-year flood plain. 15. Flora/Fauna Resources: No formal flora/fauna study was submitted with the application as the site has been used extensively for residential purposes for several decades. 16. Archaeological Resources: It is highly unlikely that any archaeological, cultural or historic sites are present on the property as the property has been fully development with a dwelling from about 1962 to 2006, when it was demolished. In a letter dated August 25, 2015, the State Historic Preservation Division determined that no historic properties will be affected by the rezone since because the property has been subject to residential/urban development. 17. Cultural or Native Gathering Rights: There is no evidence of any traditional and customary Native Hawaiian rights being practiced on the site. 18. Public Access: There is no record of public access that traverses the property. 19. Traffic: According to the Institute of Transportation Engineers Trip Generation Handbook 7th Edition, a 13,000-square foot medical office building is estimated to generate about 58 peak hour trips during the p.m. peak period. PUBLIC UTILITIES AND SERVICES 20. Access: Access to the property is from Lono Street and Kino`ole Street, which are County roads. Lono Street has a pavement width of 20 feet with no sidewalk improvements within a 60-foot wide right-of-way. Kino`ole Street has a pavement width of 36 feet with 10-foot wide (4-foot paved, 6-foot grass) sidewalks within a 60-foot right- of-way. 21. Water: County water can be made available to the site. 22. Wastewater: The property is located in an area that the Department of Health has -3- designated as a Critical Wastewater Disposal Area. The property will connect to the existing public sewer system. 23. Solid Waste: Solid waste will be disposed at the Hilo landfill. 24. This parcel is located on the south corner of Kinoole and Lono Streets in the immediate vicinity of other commercial properties that include a medical office complex, Big Island Educational Federal credit union, food establishments, service businesses &offices. Approval of this rezoning is subject to a number of performance conditions, one of which (Condition E) required the completion of the proposed commercial development by January 26, 1997. In 1995,conditional plan approval for a proposed 13,000 square feet building was issued by the Planning Department. In anticipation of the development of the property,the existing residence was demolished. A request for time extension was granted until January 26, 2000 as provided for by Condition N of said ordinance. Despite our best efforts, to date, we have not been able to proceed with and complete the project. The proposed development was impeded in years subsequent to the issuance of the conditional plan approval in 2000 by personal health issues that affected our ability to actively market and complete the project. In addition, havoc in the financial markets created an economic hardship that hindered the financial viability of the proposed project. These unforeseen personal and financial challenges combined with timing issues since the rezoning approval increased the development risk and as a result,the project has not been completed as originally planned. We have retained the property over the years in anticipation of completing a development that would satisfy our personal needs by providing a facility that would accommodate a dental laboratory for myself and a financial services office for my wife; businesses that we currently conduct at other locations in Hilo. While we were not able to complete this commercial project within the timeframe prescribed by the ordinance, we remain committed to see its completion as evidenced by our continued ownership of this property for over 20 years. We are not speculative developers;,rather, a local family seeking to create a permanent home for our businesses and possibly other commercial opportunities. Should any of the conditions not be met or substantially complied with in a timely fashion, the Director shall initiate rezoning of the area to its original or more appropriate designation. -5- SECTION 3 . In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 . This ordinance shall take effect upon its approval . Since this recommendation is made without the benefit of public testimony,the Director reserves the right to modify and/or alter this position based upon additional information presented at the public hearing. This favorable recommendation is based on the following findings: The applicants request a 5-year time extension to comply with Condition E of Change of Zone Ordinance No. 94 06, which states: "Construction of the proposed commercial development shall be completed within three(3) years from the effective date of this ordinance." This condition required that construction be completed by January 26, 1997. In 1996, the Planning Director issued an administrative time extension until January 26, 2000 to complete construction. The applicants are requesting a 5-year time extension from the date of approval of this proposed amendment to complete construction of a medical office building or other commercial development. They have been unable to proceed with construction of the project due to unforeseen personal health issues and the recent recession. However, they are committed to completing construction of an office building to accommodate a dental laboratory and financial services office for the applicants, businesses that they currently conduct in other locations in Hilo, and other commercial opportunities. The non-performance is the result of conditions that could not have been foreseen or are beyond the control of the applicant, successors or assigns, and that are not the result or their fault or negligence. Conditions of the change of zone ordinance required that the applicants secure water commitments from the Department of Water Supply(DWS) and secure Final Plan Approval for the proposed commercial development from the Planning Director. It does not appear that water commitments -1- Re: Bill 109/Comm. 524 have been secured to date, however in their memo dated July 31, 2015 the DWS indicated that County water is still available for the proposed development. Additionally, in 1995 the applicants secured Final Plan Approval for an approximately 13,000-square foot office building and related improvements. In 2006, the existing dwelling was demolished in anticipation of developing the property. The applicants have been unable to complete development of the property due to unforeseen personal health issues that affected their ability to market the property and the recent recession which limited their ability to secure financing. However,the applicants remain committed to completing the commercial development as evidenced by their continued ownership of the property for over 20 years. Thus, the applicants have been working towards compliance with the conditions of the change of zone and non-performance is the result of conditions that could not have been foreseen and were beyond the control of the applicant. Approval of this request would not be contrary to the General Plan or Zoning Code nor the original reasons for granting the Change of Zone. There have not been any significant changes to the General Plan for this area since the rezone was approved in 1994. At that time the General Plan LUPAG Map designation for the property was the same that it is today, High Density Urban. This designation allows for general commercial,multiple family residential (up to a density of 87 units per acre) and related services, thus the current General Commercial (CG) zoning is consistent with the General Plan designation. A comprehensive change was made to the Zoning Code in 1996, two years after the rezone was approved. Plan Approval No. 2987, which was issued in 1995, included reduced off-street parking,minimum yards and landscaping requirements than the current Zoning Code. For example, there was no minimum side yard requirement for the property in 1994,whereas today the minimum side yard requirement is 15 feet. The off- street parking requirement also increased from 1 parking stall per 400 square feet of gross floor area to 1 parking stall per 300 square feet of gross floor area. Additionally, in 2008 the County Council adopted concurrency requirements in the Zoning Code which will require that the applicant complete a traffic impact analysis report and mitigate any adverse impact prior to developing the property. Based on these significant changes in the Zoning Code since the rezone was originally granted, the Planning Director has -2- invalidated the original Plan Approval No. 2987, and will require the applicants secure a new Plan Approval for the proposed commercial development based upon the current Zoning Code. The Department of Public Works (DPW) has recommended that in addition to the current conditions of approval related to frontage improvements to Lono Street,the applicant install a full width concrete sidewalk along the property's Kino`ole Street frontage. There are currently curb, gutter and sidewalk improvements along the property's Kino`ole Street frontage,but the sidewalk has only 4-foot wide pavement and 6-foot wide grass rather than the standard 10-foot wide paved sidewalk recommended by DPW. With the addition of a condition to address DPW's recommendation, the amendment request will not unreasonably burden public agencies to provide infrastructure and utilities to the property. This favorable recommendation is made with the understanding that the applicant remains responsible for complying with all other applicable governmental requirements in connection with uses permitted within the General Commercial zoning district, prior to its commencement or establishment upon the subject property. Additional governmental requirements may include the issuance of building permits, compliance with the Fire Code, installation of improvements required by the American with Disabilities Act (ADA), among many others. Compliance with all applicable governmental requirements is a condition of this favorable recommendation; failure to comply with such requirements will be considered a violation that may result in enforcement action by the Planning Department and/or the affected agencies. Based on the above findings, the Planning Director recommends that a favorable recommendation be forwarded to the County Council to amend Ordinance No. 94 06. In addition, the Planning Director recommends that existing conditions in the ordinance be revised to reflect the current standard language for conditions of approval. L. The property shall connect to the public sewer in accordance with Section 21-5 of the Hawai`i County Code prior to issuance of a Certificate of Occupancy. If required by the Director of the Department of Environmental Management (DEM), the applicants shall conduct a sewer study in accordance with the then applicable wastewater system design standards prior to approval to connect to the County sewer system. Applicants shall provide such sewer line or other facility improvements as the Director of DEM may reasonably require, which the sewer study may indicate are advisable for mitigation of impacts of the proposed project. In lieu of paying the fair share contribution, the applicant may contribute land and/or construct improvements/facilities related to parks and recreation, fire, police, solid waste disposal facilities and roads within the region impacted by the proposed development, subject to the review and recommendation of the Planning -6- Director, upon consultation with the appropriate agencies and approval of the County Council. To ensure that the Goals and Policies of the Housing Element of the General Plan are implemented,the applicant shall comply with the requirements of Chapter 11, Article 1, Hawai`i County Code relating to Affordable Housing Policy. This requirement shall be approved by the Administrator of the Office of Housing and Community Development prior to Final Subdivision Approval or Final Plan Approval, whichever is applicable. The applicants shall comply with all applicable County, State and Federal laws, rules,regulations and requirements. R. An initial extension of time for the performance of conditions within the ordinance may be granted by the Planning Director upon the following circumstances: 1. The non-performance is the result of conditions that could not have been foreseen or are beyond the control of the applicants, successors or assigns, and that are not the result of their fault or negligence. 2. Granting of the time extension would not be contrary to the General Plan or Zoning Code. 3. Granting the time extension would not be contrary to the original reasons for the granting of the change of zone. 4. The time extension granted shall be for a period not to exceed the period originally granted for performance(i.e., a condition to be performed within one year may be extended for us to one additional year). 5. If the applicant should require an additional extension of time, the Planning Director shall submit the applicant's request to the County Council for appropriate action. -7- S.
