COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 124 <br />AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5 OF THE <br />HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEES. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Purpose. <br />The purpose of this ordinance is to modify the terms of membership and tenure to provide <br />for better continuity of membership and to allow interested members the opportunity to serve for <br />a longer period of time. <br />SECTION 2. Chapter 16, article 3, section 16-5, Hawaii County Code 1983 (2005 Edition, <br />as amended), is amended to read as follows: <br />"Section 16-5. Membership and tenure. <br />(a) The CDP action committee shall consist of nine members. All members shall have a primary <br />residence in the area covered by the CDP. The members shall be appointed by the mayor <br />and approved by the County council. If a position remains vacant for more than three <br />months, a person to fill the position may be appointed by a council member who represents <br />the area encompassed by the respective CDP, and the appointment approved by the council. <br />Prior service as a member of a CDP steering committee shall not disqualify an individual <br />from serving on the CDP action committee. <br />(b) The members shall serve staggered terms of four years. Upon the initial appointment of the <br />committee, three members shall serve for a term of two years, three members for a term of <br />three years, and three members for a term of four years. Subsequently, members may be <br />appointed for up to three terms. When the term of a member expires, the member shall <br />continue to serve until a successor is appointed. Existing vacancies shall be filled prior to <br />replacing any member whose term has expired but is willing to continue serving until the <br />vacancies are filled. <br />(c) The membership should reflect a broad cross-section of the community. The community <br />development plan may specify more detailed selection criteria consistent with this objective. <br />(d) A chairperson shall be elected from its membership annually. <br />(e) Except as provided for in this section, the committee shall be governed by the County <br />Charter, section 13-4." <br />
