COUNTY OF HAWAII RESOLUTION NO. STATE OF HAWAII 367 16 A RESOLUTION ACCEPTING THE GRANT OF EASEMENT FOR SLOPE AND DRAINAGE PURPOSES AND ELECTRICAL PURPOSES FOR SCD -TSA KALOKO MAKAI LLC., SITUATED AT KALOKO, DISTRICT OF NORTH KONA, ISLAND AND COUNTY OF HAWAII, STATE OF HAWAII, TMK NO. (3) 7-3-009:028 (POR) AND 7- 3-009:063 (POR) FROM SCD -TSA KALOKO MAKAI LLC. WHEREAS, SCD -TSA Kaloko Makai LLC is the owner of the slope, drainage, and electrical easements over, under, across, upon and through the premises and more fully described in Exhibit "A", and depicted on Exhibit "B" attached hereto, located at Kaloko, District of North Kona, County of Hawaii, State of Hawaii, identified as TMK No. (3) 7-3-009:028 (por) and 7- 3-009:063 (por); and WHEREAS, SCD -TSA Kaloko Makai LLC is desirous of granting the County of Hawaii the slope, drainage, and electrical easements that are found on the premises as described in Exhibit "A" and depicted on Exhibit "B" attached hereto; and WHEREAS, the slope, drainage, and electrical easements have been inspected and found to be in acceptable condition and in compliance with the provisions of Chapter 23 of the Hawaii County Code; and WHEREAS, the Department of Public Works, the Department of Environmental Management, the Department of Water Supply and the Planning Department have no objection to the acceptance of the slope, drainage, and electrical easements; and WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of such easements be in compliance with Chapter 23 of the subdivision code; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the Council may accept gifts, including real estate or any interest in real estate, on behalf of the County of Hawaii; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies.
