COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />367 16 <br />A RESOLUTION ACCEPTING THE GRANT OF EASEMENT FOR SLOPE AND <br />DRAINAGE PURPOSES AND ELECTRICAL PURPOSES FOR SCD -TSA KALOKO <br />MAKAI LLC., SITUATED AT KALOKO, DISTRICT OF NORTH KONA, ISLAND AND <br />COUNTY OF HAWAII, STATE OF HAWAII, TMK NO. (3) 7-3-009:028 (POR) AND 7- <br />3-009:063 (POR) FROM SCD -TSA KALOKO MAKAI LLC. <br />WHEREAS, SCD -TSA Kaloko Makai LLC is the owner of the slope, drainage, and <br />electrical easements over, under, across, upon and through the premises and more fully described <br />in Exhibit "A", and depicted on Exhibit "B" attached hereto, located at Kaloko, District of North <br />Kona, County of Hawaii, State of Hawaii, identified as TMK No. (3) 7-3-009:028 (por) and 7- <br />3-009:063 (por); and <br />WHEREAS, SCD -TSA Kaloko Makai LLC is desirous of granting the County of <br />Hawaii the slope, drainage, and electrical easements that are found on the premises as described <br />in Exhibit "A" and depicted on Exhibit "B" attached hereto; and <br />WHEREAS, the slope, drainage, and electrical easements have been inspected and found <br />to be in acceptable condition and in compliance with the provisions of Chapter 23 of the Hawaii <br />County Code; and <br />WHEREAS, the Department of Public Works, the Department of Environmental <br />Management, the Department of Water Supply and the Planning Department have no objection <br />to the acceptance of the slope, drainage, and electrical easements; and <br />WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of <br />such easements be in compliance with Chapter 23 of the subdivision code; and <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the <br />Council may accept gifts, including real estate or any interest in real estate, on behalf of the <br />County of Hawaii; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it <br />finds the subject subdivision and improvements thereon are in full compliance with the <br />provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable <br />agencies. <br />
