i+ or <br />COUNTY OF HAWAII STATE OF HAWAII <br />BILL NO. 142 <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 36, ARTICLE 1, SECTION 36-1; ARTICLE <br />4, SECTION 36-6; AND ARTICLE 5, SECTION 36-8 AND SECTION 36-9 OF THE <br />HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />REDISTRICTING. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Purpose. The purpose of this ordinance is to increase the allowable <br />deviation from an ideal council district population when establishing district boundaries <br />during the redistricting process in order to provide greater opportunity to keep established <br />communities intact within the same council district boundary. <br />SECTION 2. Chapter 36, article 1, section 36-1 of the Hawaii County Code 1983 (2005 <br />Edition, as amended), is amended by amending the definition of "Council district deviation" to <br />read as follows: <br />""Council district deviation" means the number of percentage points plus or minus [4-99] <br />nine percent that a population assigned to a council district differs from that of an ideal council <br />district's population." <br />SECTION 3. Chapter 36, article 4, section 36-6 of the Hawaii County Code 1983 (2005 <br />Edition, as amended), is amended to read as follows: <br />"Section 36-6. Maximum council district deviation. <br />(a) The maximum council district deviation for a proposed council district shall not exceed <br />plus or minus [4:99] nine percent of an ideal council district's population. <br />(b) If practicable, documented, high-growth areas shall be drawn to receive the most negative <br />council district deviation percentage in the final plan so that as a high growth area or <br />district continues to increase in population between census years, the council district's <br />deviations may be equalized." <br />
