No. 755/Bill No. 169 <br /> PLACE: Council Chambers <br /> Hilo, Hawai`i <br /> TIME: 9:30 a.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i 96720 <br /> Your Committee on Planning, to which was referred Bill No. 169, reports as follows: <br /> Bill No. 169, transmitted by Mayor William P. Kenoi via Communication No. 755 dated March 14, <br /> 2016, amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the <br /> Hawaii County Code 1983 (2005 Edition), by changing the district classification from Family <br /> Agricultural—Two Acres (FA-2a) to Family Agricultural-One Acre (FA-1a) at Ponahawai, South Hilo, <br /> Hawai`i, covered by Tax Map Key: 2-5-040:042. The applicants are Francis H. and Martha A. Rodillas, <br /> and the subject parcel covers 2.724 acres. The applicants propose to subdivide the property into two <br /> parcels for family. <br /> The Windward Planning Commission, at its duly held public hearing on March 3, 2016, recommended <br /> approval of this bill. <br /> Mr. Chung asked the applicants to comment on the fair share contribution in Condition L. <br /> The applicants asked the Council to waive the fair share assessment because the cost of installing a fire <br /> hydrant and extending the water line exceeds the total cost of the fair share assessment. <br /> Mr. Chung asked Planning Director Duane Kanuha whether he had any comments, and also whether <br /> there is precedent for the Council waiving a fair share assessment <br /> Director Kanuha stated there was not any precedent of which he was aware, and it would be an action to <br /> be taken by the Council. <br /> Mr. Chung asked Director Kanuha how he would prefer to proceed. <br /> Director Kanuha said the applicant's cost relating to water is not included as a fair share component. The <br /> department has considered in the past lumping the fair share assessment based on what the main impacts <br /> of the components are, based on the area of the specific project roadway improvements, and offset the <br /> other components. In this case, the fair share component to support fire facilities is $620.58, which is far <br /> outweighed by the cost to install the fire hydrant. Reallocation of the fair share costs has been done <br /> before. <br /> Mr. Chung stated his preference for moving forward and said he would prepare an amendment. <br /> PC Report No.: 56 <br />
