COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 154 <br />(DRAFT 3) <br />AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE 111, SECTION 3-2 <br />OF THE IIAWAPI COUNTY CHARTER (2014), RELATING TO COUNTY COUNCIL <br />TERMS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Article Ill, section 3-2 of the Hawaii County Charter (2014), is <br />amended to read as follows: <br />"Section 3-2. Composition and Terms. <br />There shall be a county council composed of nine members. One member shall be <br />elected from each of nine districts. The terms of the council members shall be two years <br />and shall begin at twelve o'clock meridian on the first Monday of December after their <br />election. [The os�,._...«6eFs shall not exceed four eenseei e t%.. year <br />terms] No council member shall be eligible to run for re-election as an incumbent after <br />having served five consecutive full two-year terms Candidates shall be elected in <br />accordance with the election laws of the state, insofar as applicable." <br />SECTION 2. Charter material to be repealed is bracketed and stricken. New <br />material is underscored. When revising, compiling, or printing these charter provisions <br />for inclusion in the Charter of the County of Hawaii, the reviser need not include the <br />brackets, bracketed and stricken material, and underscoring. <br />SECTION 3. If any provision of this ordinance or the application thereof to any <br />person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance, which can be given effect without the invalid provision or <br />application, and to this end, the provisions of this ordinance are severable. <br />SECTION 4. Upon adoption of this ordinance, this Council, by appropriate <br />resolution, shall provide that this amendment be submitted to the electorate of Hawai' i <br />County for approval in the 2016 general election. <br />
