COUNTY OF HAWAII 'I `A ' '''/;• STATE OF HAWAII <br /> BILL NO. <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING ORDINANCE NO. 889, (FORMERLY KAMUELA <br /> ZONE MAP, CURRENTLY LALAMILO PU`UKAPU ZONE MAP) WHICH <br /> RECLASSIFIED LANDS FROM AGRICULTURAL—FORTY ACRES (A-40a) TO <br /> AGRICULTURAL—FIVE ACRES (A-5a) AT PU`UKAPU HOMESTEADS,2ND <br /> SERIES,SOUTH KOHALA,HAWAII COVERED BY TAX MAP KEY 6-4-017:023, <br /> 064-067 AND 078 (FORMERLY 6-4-017:023). <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Ordinance No. 889 is amended as follows: <br /> "Section 1. Section [7:09] 25-8-11, Article [2] 8, Chapter[8] 25 (Zoning Code) of the <br /> [Hawaii}Hawai`i County Code 1983 (2005 Edition), [as] is amended, [is further-amended add <br /> a new subsection, to r ad] to change the district classification of property described hereinafter <br /> as follows: <br /> ["7.09 ( r).] The district classification of the following area situated at [Puukapu} <br /> Pu'ukapu Homesteads, 2"d Series, South Kohala,[14awaii}Hawaii, shall be Agricultural—5 <br /> acres (A-5a): <br /> SECTION 2. In accordance with Section 25-2-44, Hawai`i County Code 1983 (2005 <br /> Edition),the County Council finds the following conditions are: <br /> (1) Necessary to prevent circumstances which may be adverse to the public <br /> health, safety and welfare; or <br /> (2) Reasonably conceived to fulfill needs directly emanating from the land use <br /> proposed with respect to: <br /> (A) Protection of the public from the potentially deleterious effects of <br /> the proposed use, or <br /> (B) Fulfillment of the need for public service demands created by the <br /> proposed use. <br /> Planning Dept. <br /> Exhibit D <br />
