J�ZY Oc p : ., • COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 227 17 A RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO INVITE PROPOSALS FOR LEASE BY NEGOTIATION OF 900 ACRES OF AGRICULTURAL COUNTY-OWNED LEASE LANDS, BEING TAX MAP KEY NO.: 4-2-005:001, KOHOLALELE , HAMAKUA,HAWAII PURSUANT TO CHAPTER 2,ARTICLE 19, SECTION 2-114 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED). WHEREAS,the County of Hawai`i is the owner of certain premises, located in Koholalele, Hamakua, Hawai`i, identified as Tax Map Key No.: 4-2-005:001 and comprising a total of 900 leasable acres; and WHEREAS, in 1994, the Council of the County of Hawai`i agreed to accept this land by Commissioner's Quitclaim Deed as a settlement for retroactive real property taxes among Western Farm Credit Bank, the County of Hawai`i and Hamakua Sugar Company, Inc.; and WHEREAS,there is a need for agricultural lands along the Hamakua coast for the purposes of farming, cattle grazing, and ranching; and WHEREAS, Chapter 2, Article 19, Section 2-114, Subsection(a) of the Hawai`i County Code 1983 (2016 edition, as amended) provides in pertinent part that real property may be leased through negotiation upon a finding by the Council that the public interest demands it. This Subsection further provides that any lease by negotiation is subject to the approval of the minimum conditions and selection criteria of the Council; and WHEREAS,the Council feels that these lands are appropriate to be leased by negotiation for the purposes of diversified agriculture, eco-tourism, and pastoral uses; and WHEREAS,the County and tenant(s) would both benefit from the agricultural development of this land and the resulting economic impact on the community; and WHEREAS, the Council does not wish for the lands to remain idle and become overgrown and susceptible to fire hazards; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,that pursuant to Chapter 2, Article 19, Section 2-114 of the Hawai`i County Code 1983 (2016 edition, as amended), the Council hereby finds that it is in the public's interest that all or a portion of the 900 acres of Hamakua land as described herein shall be leased by negotiation.
