........ <br /> J�ZY Oc p : <br /> ., • <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 227 17 <br /> A RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO INVITE <br /> PROPOSALS FOR LEASE BY NEGOTIATION OF 900 ACRES OF AGRICULTURAL <br /> COUNTY-OWNED LEASE LANDS, BEING TAX MAP KEY NO.: 4-2-005:001, <br /> KOHOLALELE , <br /> HAMAKUA,HAWAII PURSUANT TO CHAPTER 2,ARTICLE 19, <br /> SECTION 2-114 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS <br /> AMENDED). <br /> WHEREAS,the County of Hawai`i is the owner of certain premises, located in <br /> Koholalele, Hamakua, Hawai`i, identified as Tax Map Key No.: 4-2-005:001 and comprising a <br /> total of 900 leasable acres; and <br /> WHEREAS, in 1994, the Council of the County of Hawai`i agreed to accept this land by <br /> Commissioner's Quitclaim Deed as a settlement for retroactive real property taxes among <br /> Western Farm Credit Bank, the County of Hawai`i and Hamakua Sugar Company, Inc.; and <br /> WHEREAS,there is a need for agricultural lands along the Hamakua coast for the <br /> purposes of farming, cattle grazing, and ranching; and <br /> WHEREAS, Chapter 2, Article 19, Section 2-114, Subsection(a) of the Hawai`i County <br /> Code 1983 (2016 edition, as amended) provides in pertinent part that real property may be leased <br /> through negotiation upon a finding by the Council that the public interest demands it. This <br /> Subsection further provides that any lease by negotiation is subject to the approval of the <br /> minimum conditions and selection criteria of the Council; and <br /> WHEREAS,the Council feels that these lands are appropriate to be leased by <br /> negotiation for the purposes of diversified agriculture, eco-tourism, and pastoral uses; and <br /> WHEREAS,the County and tenant(s) would both benefit from the agricultural <br /> development of this land and the resulting economic impact on the community; and <br /> WHEREAS, the Council does not wish for the lands to remain idle and become <br /> overgrown and susceptible to fire hazards; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,that <br /> pursuant to Chapter 2, Article 19, Section 2-114 of the Hawai`i County Code 1983 (2016 edition, <br /> as amended), the Council hereby finds that it is in the public's interest that all or a portion of the <br /> 900 acres of Hamakua land as described herein shall be leased by negotiation. <br />
