KITAGAWA & CO., LTD) has <br /> submitted a request for an extension of time to comply with Condition B (required water <br /> commitment payment) and Condition C (Complete Construction) of Ordinance No. 03 108, <br /> .,y <br /> which rezoned approximately 22,500 square feet of land from the Single-Family Residential— <br /> 10,000 square feet(RS-10) district to the Industrial-Commercial Mixed Use—20,000 square feet <br /> (MCX-20) district. The property is located on the northeast corner of the East Kawili Street and <br /> Hinano Street intersection, Waiakea House Lots Extension, Waiakea, South Hilo, Hawai`i, <br /> TMK: 2-2-050:014. <br /> PROPOSED ACTION <br /> 1. Request and Reasons for Request: The applicant is requesting a time extension to <br /> comply with Conditions B and C. Condition B required a water commitment fee to be <br /> paid within ninety(90) days fromthe effective date of Ordinance 03 108. Condition C <br /> required construction to be completed within five (5) years from the effective date of <br /> Ordinance 03 108. If granted, the request will allow the water commitment fee to be paid <br /> within ninety(90) days and construction to be completed within five (5) years from the <br /> effective date of this amended Ordinance. The proposed project is an approximately <br /> 11,600-square foot building for office/retail spaces, to be occupied by the sole tenant, the <br /> United States Veterans Administration. The applicant has experienced unforeseen design <br /> delays and a change of land ownership, thus, the construction of the proposed project was <br /> not completed by the administratively granted deadline of July 9, 2013. The applicant is <br /> in the midst of securing a new contractor and is committed to completing the construction <br /> and related improvements for this project in a timely fashion. <br /> (Planning Department Exhibit 1 —Time Extension Request) <br /> 2.
