ttYofh <br /> 4Lf <br /> COUNTY OF HAWAII +� �'- %=.t STATE OF HAWAII <br /> RESOLUTION NO. 374 a <br /> A RESOLUTION AMENDING RESOLUTION NO. 360-16, DRAFT 2, WHICH ACCEPTED <br /> THE DONATION OF LOT 31 OF THE HAWAIIAN PARADISE PARK SUBDIVISION, <br /> BEING TAX MAP KEY: (3)1-5-039:267, SITUATED AT KEA'AU,DISTRICT OF PUNA, <br /> COUNTY AND STATE OF HAWAII, FROM HAWAIIAN PARADISE PARK OWNERS <br /> ASSOCIATION. <br /> WHEREAS, On January 22, 2016, the Council adopted Resolution No. 360-16, Draft 2, which <br /> authorized the County to accept the donation of a nearly 20-acre lot from the Hawaiian Paradise Park <br /> Owners Association for the purpose of developing a County park within the Hawaiian Paradise Park <br /> subdivision; and <br /> WHEREAS, Resolution No. 360-16, Draft 2, established a two-year requirement for <br /> completion of a master plan for the park with the requirement to begin on the date that the property <br /> was successfully conveyed to the County; and <br /> WHEREAS,the lot was successfully conveyed to the County of Hawai`i on March 17, 2016; <br /> and <br /> WHEREAS, Resolution No. 360-16, Draft 2, included an instruction that the Director of <br /> Finance be required to revert the donation of Lot 31 of the Hawaiian Paradise Park subdivision from <br /> the County of Hawai`i back to the Hawaiian Paradise Park Owners Association if the two-year <br /> condition was not met; and <br /> WHEREAS,the Council seeks to extend the two-year condition by an additional year, and the <br /> Hawaiian Paradise Park Owners Association is in agreement with this extension; now,therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the <br /> Council hereby amends Resolution No. 360-16, Draft 2, by extending the deadline to complete the <br /> master plan for the County park to be located in the Hawaiian Paradise Park subdivision to March 17, <br /> 2019. <br /> BE IT FURTHER RESOLVED that the Director of Parks and Recreation is directed to <br /> complete a master plan for this park on or before March 17, 2019. <br /> BE IT FURTHER RESOLVED that if the master plan is not completed by March 17, 2019, <br /> this donation shall be deemed invalid and the Director of Finance is directed to take steps to revert <br /> ownership of the subject parcel to the Hawaiian Paradise Park Owners Association. <br />
