Kahawaiola' a a native Hawaiian as defined under the <br /> Hawaiian Homes Commission Act, 1920 as amended July 9, 1921 and currently <br /> serve as the president of the Keaukaha Community Association (KCA) which <br /> according to the 2010 census there residing in the Keaukaha Community <br /> proper was 1457 people in approximately 420 homes . We are a Hawaiian <br /> homestead community established through an Act of Congress in 1920 . We are <br /> the second oldest homesteads community formerly known as Kuhio Settlement <br /> after Molokai. 61 original lessees were awarded their leases in December <br /> 16, 1924 and we are celebrating our 93nd year of existence. <br /> This again is a bit of confusing legislation from this County Finance <br /> Director Collins Tomei, Hawaii County Mayor Harry Kim who has represented <br /> to this community and it' s beneficiaries "...the County has No Jurisdiction <br /> on lands having the status of Hawaiian Home lands..." BUT can continue to <br /> assert Jurisdictions through Hawaii County Codes and Ordinances on the <br /> encumbrances held on Hawaiian Home lands WITHOUT presenting the CONSENT OF <br /> THE UNITED STATES CONGRESS to do so. We need CLARIFICATIONS from this <br /> County to DEFINITIVELY to put these matters to rest . State constitution, <br /> the Admissions Act and several lawsuits clearly set up procedures to be <br /> followed when dealing with the Trust Lands set aside by the US Congress in <br /> 1920 and codified July 9, 1921 . <br /> Some of the misconceptions being dealt with by beneficiaries are: <br /> I) Hawaii County wastewater sewer system and if so where will the <br /> sewer lines be located in proximity to the Keaukaha homesteads? <br /> *** the concern there is the Hawaii County has an ordinance which <br /> states in part "...if you live in close proximity to a sewer line <br /> the resident will pay a sewer assessment fee whether or not hooked <br /> up to same..." *** <br /> 2) Reimburse the County for conversion of streetlights to energy <br /> efficient LED; <br /> 3) Legality of MOU with the County and DHHL promulgated in 2000 <br /> Ooennt No. 401.-a <br /> Ref. <br /> Ref.
