Kahawaiola' a a native Hawaiian as defined under the Hawaiian Homes Commission Act, 1920 as amended July 9, 1921 and currently serve as the president of the Keaukaha Community Association (KCA) which according to the 2010 census there residing in the Keaukaha Community proper was 1457 people in approximately 420 homes . We are a Hawaiian homestead community established through an Act of Congress in 1920 . We are the second oldest homesteads community formerly known as Kuhio Settlement after Molokai. 61 original lessees were awarded their leases in December 16, 1924 and we are celebrating our 93nd year of existence. This again is a bit of confusing legislation from this County Finance Director Collins Tomei, Hawaii County Mayor Harry Kim who has represented to this community and it' s beneficiaries "...the County has No Jurisdiction on lands having the status of Hawaiian Home lands..." BUT can continue to assert Jurisdictions through Hawaii County Codes and Ordinances on the encumbrances held on Hawaiian Home lands WITHOUT presenting the CONSENT OF THE UNITED STATES CONGRESS to do so. We need CLARIFICATIONS from this County to DEFINITIVELY to put these matters to rest . State constitution, the Admissions Act and several lawsuits clearly set up procedures to be followed when dealing with the Trust Lands set aside by the US Congress in 1920 and codified July 9, 1921 . Some of the misconceptions being dealt with by beneficiaries are: I) Hawaii County wastewater sewer system and if so where will the sewer lines be located in proximity to the Keaukaha homesteads? *** the concern there is the Hawaii County has an ordinance which states in part "...if you live in close proximity to a sewer line the resident will pay a sewer assessment fee whether or not hooked up to same..." *** 2) Reimburse the County for conversion of streetlights to energy efficient LED; 3) Legality of MOU with the County and DHHL promulgated in 2000 Ooennt No. 401.-a Ref.
