REPORT OF THE
COMMITTEE ON PUBLIC SAFETY
AND MASS TRANSIT
DATE: January 23, 2018 Re: Comm. No. 684/Bill No. 91
PLACE: Council Chambers
Kailua-Kona, Hawai`i
TIME: 9:09 a.m.
Council Chair and Members
Hawai`i County Council
Hilo, Hawai`i 96720
Your Committee on Public Safety and Mass Transit, to which was referred Bill 91, reports as
follows:
Bill 91, transmitted by Council Chairwoman Valerie Poindexter, via Communication 684, dated
January 4, 2018, amends Chapter 26 of the Hawaii County Code 1983 (2016 Edition, as
amended) by adding a new Article 3,that would reestablish the Fire Board of Appeals.
This bill was introduced at the request of the Fire Department. Among other duties, the Fire
Board of Appeals hears and issues rulings on appeals from final decisions of the Fire Chief
relating to Article 1, the County Fire Code and Article 2, the Fireworks Code.
Fire Battalion Chief Robert Perreira was in the Hilo Council Chambers and said the restarting of
the Fire Board of Appeals was needed so that specific fire code requirements could be enforced
and upheld. Currently, the Fire Inspectors tie violation notices to building and electrical code
violations to avoid their findings being void upon appeal. Also discussed was adding ex officio
board members.
Your Committee on Public Safety and Mass Transit is in accord with the purpose and intent of
Bill No. 91, and recommends its passage on first reading.
nh
AYES NOES ABS EX Respectfully submitted,
CHUNG _ X
DAVID _ x COMMITTEE ON PUBLIC SAFETY
EOFF x AND MASS TRANSIT
KANUHA X
LEE LOY X i
O'HARA _ X
POINDEXTER x JE 4 IFE' RUGGLES, CHAIR
RICHARDS _ X PSMTC REPORT NO.: 3
RUGGLES X ADOPTED: FEB 0 7 2018
