The Department of Land Natural Resources-State Historic Preservation <br /> Division (DLNR-SHPD) issued a"no historic properties affected" letters dated <br /> November 22, 2017, stating that no historic properties will be affected by this project. <br /> DLNR-SHPD records indicated that there are no known archaeological sites and that <br /> there has been no archaeological inventory survey(AIS) of this project area. However, <br /> available photos indicated that the area has been impacted by urban development and <br /> previous grading and grubbing. Presently, there is no evidence of any traditional and <br /> customary Native Hawaiian rights being practiced on the site, nor existence of known <br /> valued cultural, historical or native resources in the area. Thus, it is not anticipated that <br /> the proposedrequest will have any adverse impact on cultural or historical resources in <br /> the area. <br /> The request will not have a significant adverse impact to traditional and <br /> customary Hawaiian Rights. In view of the recent Hawai`i State Supreme Court's <br /> "PASH" and "Ka Pa`akai 0 Ka Aina" decisions, the issue relative to native Hawaiian <br /> gathering and fishing rights must be addressed in terms of the cultural, historical, and <br /> natural resources and the associated traditional and customary practices of the site: <br /> Investigation of valued resources: No formal archaeological reconnaissance <br /> survey, oral history of kama`aina accounts of the area, historical survey of documentary <br /> records, or botanical study was included in the application. <br /> The valued cultural,historical, and natural resources found in the rezoning area: <br /> As the site has been previously impacted by urban development and previous grading and <br /> grubbing, it is unlikely that there are any valued cultural, historical, and natural resources <br /> to be found in the rezoning area. The applicant has not submitted a formal archaeological <br /> survey but has indicated that the subject property had been formerly bulldozed and <br /> cleared. Aerial photographs of the subject property show previous land disturbance. The <br /> applicant further stated that in the event any inadvertent discoveries are made during any <br /> land disturbance activity related to this project, work will cease and the applicant will <br /> immediately notify the Planning Department and the State DLNR-SHPD and secure <br /> clearances before proceeding. <br /> Possible adverse effect or impairment of valued resources: There is no evidence <br /> of any possible adverse effects or impairments will occur to any valued resources.
