Mitchell (formerly Malulani, Inc.) <br /> Request: Five-Year Time Extension to Condition C (Complete Construction) <br /> Tax Map Key: 2-3-037:015 <br /> The Windward Planning Commission, at its duly held public hearing on July 5, 2018, <br /> recommended for your approval the proposed legislative bill for an amendment to Change of Zone <br /> Ordinance No. 07-166. The property is located on the south side of Ponahawai Street, <br /> approximately 650 feet east of its intersection with Komohana Street, Ponahawai, South Hilo, <br /> Hawai`i. <br /> The Commission concurs with the following Planning Director's reasons for recommending <br /> favorable consideration of the request: <br /> The applicant is requesting a 5-year time extension to comply with Condition C, <br /> which required completion of construction within five (5) years from the effective date of <br /> Change of Zone Ordinance No. 07 166, which reclassified approximately 1.278-acres from <br /> the Agricultural-1 acre (A-la) district to the Multiple-Family Residential-5,500 square <br /> feet (RM-5.5) zoning district in 2007. Approval of this amendment request will allow the <br /> completion of construction within,five (5) years of the effective date of this amended <br /> Ordinance.
