Recommendation#13 <br /> Add the following to Section 25-4-XX.1(f)(2): <br /> "(E) The renewal request and renewal fee was not received on or before the expiration <br /> date indicated on the certificate." <br /> Reason: This will clarify that renewal requests received after the expiration date will not <br /> be renewed. <br /> Recommendation#14 <br /> To ensure that STVR's meet basic health and safety standards, consider adding <br /> requirements that the STVR comply with fire,building and sanitation codes. For <br /> example,to address the building code, a requirement in the `Registration' and <br /> `Nonconforming Use Certificate' sections could be added stating that a STVR may only <br /> be established within a dwelling for which the Department of Public Building Division <br /> has issued and finalized building, electrical and plumbing permits to be occupied as an <br /> R-1 residential occupancy. <br /> Reason: Both the Fire and Building Departments have provided memos indicating that <br /> health and safety standards should be considered in this bill. The building code identifies <br /> STVR's as an R-1 occupancy,rather than R-3 (permanent occupant onsite),because an <br /> owner/operator does not reside onsite. The R-1 occupancy requires among other things, <br /> fire sprinklers, commercial standards for exists/guards, accommodations for persons with <br /> disabilities (ADA), energy code compliance, and verification for building setbacks for <br /> fire separation. The bill should also consider the impact on staffing resources for the Fire <br /> and Building Departments, since it is likely that inspectors from these departments will <br /> be called out more frequently to inspect STVR's for code compliance. <br /> Recommendation#15 <br /> Create increased fines for violation of this bill. <br /> Reason: The Maui and Kauai County planning departments have informed the Director <br /> that because STVR's are a very profitable business,the fines need to be high enough to <br /> discourage violation of the STVR law. Current zoning code violation fines start at$100 <br /> -14- <br />
