Mr. Michael Yee, Director <br /> May 18, 2018 <br /> Page 8 <br /> It is thus maintained that the reasons used to support the existing zoning still <br /> apply to the requested time extension. It should be noted, however, that since the CG-10 <br /> zoning was approved in 2006,the only substantive change to the Zoning Code was the <br /> adoption of the concurrency provision, Section 25-2-46. Specifically, it requires that all <br /> rezoning, including time extension, address traffic,potable water, and civil defense siren <br /> concerns. <br /> Relative to traffic,the concurrency provision requires a Traffic Impact Analysis <br /> Report("TIAR") if more than fifty (50)trips are generated by a project during the peak <br /> hours. In this situation,the proposed office use for the two structures with a combined <br /> area of 2,500+/- square feet, generates less turning movements or traffic than a retail <br /> shop. According to the Institute of Traffic Engineering manual (the manual used by <br /> traffic engineers in preparing Traffic Impact Analysis Report),the AM/PM trip <br /> generation for office use is 1.49 trips per 1,000 square feet. Thus, for a maximum 3,000 <br /> square foot office building, the projected movements would be 4.47 or less than five (5) <br /> movements. Thus, the projected use does not reach the TZAR"threshold". <br /> Notwithstanding not reaching the TIAR"threshold", of these projected maximum <br /> five (5) AM/PM movements, at least 50% or two (2) or three (3) movements would be <br /> right turn movements. Right turn movements into the project site should not significantly <br /> impede traffic along Kilauea Avenue. Further, in this area, Kilauea Avenue is wide <br /> enough to allow for through vehicles to navigate to the right of the few left turning <br /> vehicles. <br /> Nevertheless, to address the potential traffic impacts of a more intensive land use, <br /> the Applicant would be willing to accept a condition that requires a TIAR if so required <br /> by the Planning Department. This condition would be similar to other commercially <br /> zoned projects. <br /> County water for the project is still available. Further, there is a civil defense <br /> siren less than two hundred (200) feet from the subject site. As such, approval of this <br /> request should not be incongruous with the concurrency provision of the Zoning Code. <br /> V. SUGGESTED LANGUAGE • <br /> Pursuant to the request, the Applicant suggest the following language for your <br /> consideration: <br /> 1. Replacing Condition 2 with the following language, which is similar to the <br /> language of commercial rezoning requests approved today: <br />
