Poindexter, Council Chair <br /> and Members of the County Council <br /> County of Hawai`i <br /> Page 3 <br /> The applicants are simply seeking additional time to secure Final Subdivision <br /> Approval and to complete the conditions of the original approval of the change of zone <br /> request and the tentative subdivision approval. The Planning Department is supportive of <br /> the request for a time extension as the applicants are committed to completing the <br /> subdivision and related improvements. <br /> The proposed request will not unreasonably burden public agencies to provide <br /> infrastructure and utilities to the property. The property has sufficient access from Kaloko <br /> Drive. There is sufficient water and utilities for the proposed request. There are no <br /> drainage issues as the Federal Emergency Management Agency Flood Insurance Rate Map <br /> (FIRM) designates the property as Zone"X", which is an area determined to be outside of <br /> the 500-year flood plain. Additionally, the applicants have complied with Condition K, <br /> which required a fair share payment towards improving the Kaloko Drive/Mamalahoa <br /> Highway intersection. The Planning Director also recommends updating the existing <br /> conditions to reflect the current standard language and adding new conditions as requested <br /> by agencies. The applicants are committed to complying with the conditions of approval, <br /> including the requirements for protecting and maintaining the naturally forested areas on <br /> their property by creating forest reserve easements and enhanced structural setbacks on the <br /> property(s). Lastly, the applicants will be required to comply with all agency requirements <br /> and stated conditions of approval. <br /> This favorable recommendation is made with the understanding that the applicants <br /> remain responsible for complying with all other applicable county, state and federal <br /> governmental requirements in connection with uses permitted within the Agricultural <br /> zoning district, prior to its commencement and during its establishment upon the subject <br /> properties. Additional governmental requirements may include the issuance of building <br /> permits, among many others. Compliance with all applicable governmental requirements <br /> is a condition of this favorable recommendation; failure to comply with such requirements <br /> will be considered a violation that may result in enforcement action by the Planning <br /> Department and/or the affected agencies. <br /> Based on the above findings, the Planning Director recommends that a favorable <br /> recommendation be forwarded to the County Council to amend Ordinance No. 05 66. <br /> In addition, the Planning Director recommends that existing conditions in the Ordinance <br /> be revised to reflect the current standard language for conditions of approval.
