Amendment to Change of Zone Ordinance No.07-26 <br /> Hawaii Island Veterans Memorial,Inc. <br /> • Condition C (completion of construction within five years of the date of the Ordinance) <br /> • Condition Q (submittal of an annual progress report) <br /> • Condition R(request for an administrative time extension for the performance of the conditions) <br /> HIVM takes responsibility to comply with all other stated conditions of approval and will ensure compliance <br /> from any successors, until such time when Leases are conveyed to the successors. <br /> Condition B. The required water commitment payment shall be submitted to the Department of <br /> Water Supply in accordance with its "Water Commitment Guidelines Policy"within 180 days from <br /> the effective date of this ordinance. <br /> • The water commitment payment has been paid by HIVM for the CVC/CBOC project on TMK: 2-4- <br /> 057: <br /> 29 and 31, as specified in Department of Water Supply letter dated June 9, 2017 (Exhibit 15). <br /> • The affordable housing development project water commitment payment.for TMK: 2-4-057: 30, as <br /> specified in a Department of Water Supply letter dated May 16, 2017 (Exhibit 16) will be the <br /> responsibility of EAH/HKI Kawili LLC. EAH/HKI Kawili LLC requests that payment be made payable <br /> upon securing financing and prior to project construction. <br /> Condition C. Construction of the proposed improvements shall be completed within five (5)years <br /> from the effective date of this ordinance. Prior to construction, the applicant, successors or assigns <br /> shall secure Final Plan Approval for the proposed development from the Planning Director in <br /> accordance with Section 25-2-70, Chapter 25(Zoning Code), Hawaii County Code. Plans shall <br /> identify all existing and/or proposed structures, paved driveway access and parking stalls <br /> associated with the proposed development. Landscaping shall also be indicated on the plans for ( . <br /> the purpose of mitigating any adverse noise or visual impacts to adjacent properties in accordance ( _ <br /> with the requirements of Planning Department's Rule No. 17 (Landscaping Requirements). The s <br /> applicant shall comply with landscaping requirements for RM zoning. <br /> The Applicant requests a change in the project construction completion time from five (5) years to ten (10) <br /> years. The Applicant HIVM and its successor, HKI Kawili LLC, are bound by its MOU, yet both entities are <br /> seeking separate funding sources. Thus, commencement and completion of construction is dependent on <br /> the successful financing of each respective development. <br /> • Final Plan Approval documents for the CVC/CBOC on Parcel 29 have been submitted to the <br /> Planning Director, however, approval is pending the successful approval of the subject request. <br /> • Final Plan Approval documents for the Housing component on Parcel 30 will be submitted by HKI ` <br /> Kawili LLC following the approval of the subject request, and in consultation with the Office of <br /> Housing and Community Development as part of the HRS Section 201 H process. t <br /> Documents for both CVC/CBOC and Housing projects will comply with Section 25-2-70, Chapter 25, Hawaii <br /> County Code and the RM zoning district. <br /> 8 <br />
