the County Office of Housing and Community Development to obtain Hawaii Revised <br /> Statutes Section 201H status for exemptions from zoning code and ordinance condition <br /> requirements for the affordable housing project. <br /> 2. Request and Reasons for Request: The applicant is requesting to amend various <br /> conditions of Change of Zone Ordinance No. 07 26 as follows: <br /> Condition B <br /> Condition B required submittal of a water commitment payment to the <br /> Department of Water by September 16, 2007 (within 180 days of the effective date of the <br /> ordinance). Water commitments have been secured for Parcels 29 and 31 to support the <br /> combined veteran's center/community based outpatient clinic (Exhibit 15 of <br /> Application). The applicant has not yet made a water commitment payment for Parcel 30 <br /> to support the affordable housing project. This water commitment payment-will be the <br /> responsibility of EAH/HKI Kawili LLC. The applicant is requesting to amend <br /> Condition B to make the water commitment payment for Parcel 30 payable upon securing <br /> financing and prior to project construction. <br /> Condition C <br /> Condition C required that construction of the project be completed by <br /> March 20, 2012 (five years from the effective date of the ordinance). The applicant is <br /> requesting to amend Condition C to allow completion of construction of the project <br /> within ten (10) years from the effective date of the amended ordinance. The applicant <br /> has made steady, substantial progress in moving the proposed development forward and <br /> requests this additional time to secure financing and continue the permitting process. <br /> Condition F <br /> Condition F requires the applicant to design, purchase and install streetlights and <br /> traffic controls, as may be required by the Department of Public Works (DPW). The <br /> applicant requests this condition be deleted because the applicant indicates based on a <br /> verbal consultation with DPW, entrance lights and traffic control measures will not be <br /> required for the project since streetlights and traffic controls already exist as the Kawili <br /> Street-Kapi`olani Street intersection, which is in close proximity to the project's access <br /> driveways at Kawili Street and Kapi`olani Street. <br /> -2- <br />
