That consolidation was finalized on October 24, <br /> 1994 making the date to secure Final Plan Approval October 24, 1995. Condition D <br /> required commencement of construction within one (1) year of receipt of Final Plan <br /> Approval and completion of construction within two (2) years after that. Condition D was <br /> never completed as the project was abandoned. The applicant is proposing to delete <br /> Conditions C and D and replace them with a new Condition C to read as follows: <br /> "Construction of the proposed development shall be completed within five (5) <br /> years from the effective date of this amendment. Prior to construction, the <br /> applicant(s), successor(s) or assign(s)shall secure Final Plan Approval for the <br /> proposed development from the Planning Director in accordance with <br /> Section 25-2-70 Chapter 25 (Zoning Code), Hawaii County Code. Plans shall <br /> identify all existing and/or proposed structure(s),paved driveway access and <br /> parking stalls associated with the proposed development. Landscaping shall be <br /> indicated on the plans for the purpose of mitigating any adverse noise or visual <br /> impacts to adjacent properties in accordance with the requirements of Planning <br /> Department's Rule No. 17(Landscaping Requirements). " <br /> The applicant is concurrently requesting revocation of Special Management Area <br /> (SMA) Use Permit No. 334, granted in 1992 to allow the construction of a warehouse, <br /> fish processing plant, accessory office use,parking and related improvements on the <br /> subject property. Additionally, the applicant is requesting a new SMA Use Permit to <br /> develop a potable water well and bottling facility with related improvements on <br /> approximately on an approximately 31,000-square foot portion of the 2.5712-acre subject <br /> property. The proposed development will occur on the southern quarter of the property <br /> with road frontage along Piilani Street and the remainder of the property will remain <br /> vacant at this time. <br /> The non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant, successors or assigns, and that <br /> are not the result of their fault or negligence. As stated above, the original applicant, <br /> Suisan Company, LTD secured the subject change of zone ordinance and subsequently <br /> SMA Use Permit No. 334 in 1992 to develop a warehouse, fish processing plant, <br /> accessory office use, parking and related improvements in conjunction with a planned <br /> fish auction site near the mouth of the Wailoa River. Due to health and other <br /> environmental requirements, the planned use of the Suisan Fish Market auction site was <br /> terminated, this along with a sluggish economy in the 1990s caused Suisan to shift focus <br /> to improving its current location on Kalaniana`ole Avenue.
