Unger, Chair <br />Oliver "Sonny" Shimaoka, Vice Chair <br />Nancy Carr Smith <br />Scott Church <br />Perry Kealoha <br />Michael Vitousek <br />Faith "Faye" Yates <br />SUBJECT: Change of Zone Application (REZ 17-000220) <br />[Reference: REZ 524 & REZ 7091 <br />Request: Amendments to Change of Zone Ordinance Nos. 09-049 and 09-050 <br />Applicant: T & M Properties, LLC (formerly Samson, LLC) <br />Tax Map Key: 7-5-010:013 (formerly 7-5-023:064 and 067) <br />The Leeward Planning Commission, at its duly held public hearing on December 10, 2018, <br />recommended for your approval the proposed legislative bill for an amendment to Change of Zone <br />Ordinance Nos. 09-049 and 09-050. The property is located along the north and east side of <br />Hualalai Road, northwest of the Aloha Kona Subdivision, Hienaloli 4th, 5th and 6th, North Kona, <br />Hawai `i. <br />The Leeward Planning Commission voted to forward a favorable recommendation to the County <br />Council for REZ 17-000220, with an added condition (Condition B) to limit development of the <br />property to an independent senior living facility, and an added condition (Condition P) to have the <br />applicant assess the historic features at Site 13673 and submit a report to the State Historic <br />Preservation Division. <br />The Commission concurs with the following Planning Director's reasons for recommending <br />favorable consideration of the request: <br />The subject property is a dual -zoned parcel with approximately 3.227 acres zoned <br />RM -2.5 and about 3.240 acres zoned CV -7.5. The property is subject to two change of zone <br />ordinances (Ord. 09-049 and 09-050) with identical conditions of approval.
