The Director recommends revising Condition B to phase development <br />of residential units with water availability, meaning since only 50 units of water are currently <br />available the development would be limited to 50 dwelling units or its equivalent until water <br />system improvements are made and additional water becomes available. <br />This recommendation is made with the understanding that the applicant remains <br />responsible for complying with all other applicable govermnental requirements in <br />connection with the proposed development, prior to its commencement or establishment <br />upon the subject property. Additional governmental requirements may include the issuance <br />of building permits, compliance with the Fire Code, installation of improvements required <br />by the American with Disabilities Act (ADA), compliance with the State Department of <br />Health regulations related to construction noise and dust, among many others. Compliance <br />with all applicable governmental requirements is a condition of this. approval; failure to <br />comply with such requirements will be considered a violation that may result in enforcement <br />action by the Planning Department and/or the affected agencies. <br />Based on the above findings, the Planning Director recommends that the Planning <br />Commission forward to the County Council a favorable recommendation to consolidate <br />Ordinance Nos. 09-049 and 09-050 and to amend Conditions C, D and N of these ordinances <br />and add a new condition to allow an administrative time extension. <br />The accompanying draft bill consolidating Ordinance Nos. 09-049 and 09-050 and reflecting <br />the recommended amendments to conditions of approval is provided for your consideration. In <br />addition, the Planning Director recommends that existing conditions in the ordinance be revised to <br />reflect the current standard language for conditions of approval and housekeeping revisions. <br />(Material to be deleted is bracketed and struck through and material to be added is underscored). <br />We are enclosing copies of the staff Background, Planning Director's Recommendation, the Power <br />point presentation and a draft transcript of the hearing for your information. <br />Sincerely, <br />Keith F.
