(Exhibit A-Ordinance) The request was to allow the conversion of an <br /> existing single-family residence into a retail fabric and related gift shop called Kilauea <br /> Kreations,which continues to operate at the site. <br /> Condition E required`full improvements to the entire frontage along Manono <br /> Street consisting of but not limited to,pavement widening with concrete curb, gutter and <br /> sidewalk drainage improvements, and any required utility relocation, meeting with the <br /> approval of the Department of Public Works."Further,the improvements were required <br /> to be completed within five (5)years from the effective date of this ordinance."The <br /> deadline was July-17,2006,which was then extended administratively by the Planning <br /> Director on September 5,2012 to July 17,2016. <br /> Notwithstanding the conversion and while some progress has been made to • <br /> address this requirement,the required off-site improvements has still not been completed. <br /> The subject property was sold to Makalika 521,LLC ("Applicant")in 2017,who <br /> intends to fulfill this obligation. Further, whether for itself or possible successors in <br /> interest,the Applicant would like to have the flexibility of constructing a new building <br /> instead of possibly being limited to using only the existing renovated structure as may be <br /> suggested by Condition B, which reads, in part "Conversion of the existing dwelling shall <br /> be completed within five (5)years from the effective date of this ordinance." <br /> As such and through this office,the Applicant is requesting a time extension <br /> amendment of the subject ordinance to allow completion of the required off-site <br /> infrastructure as well as to make clear that a new structure could be constructed on the <br /> site.
