J�tY Ofp • <br /> COUNTY OF HAWAII •EPS' '/ STATE OF HAWAII <br /> rE oi'M►'� <br /> RESOLUTION NO. . 93 19 <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO <br /> ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII, BY <br /> ITS DIRECTOR OF TRANSPORTATION, FOR THE COOPERATION <br /> AND PROVISION OF ASSISTANCE FOR VARIOUS ROAD AND/OR <br /> ROAD RELATED PROJECTS ON OR FOR STATE OR COUNTY <br /> HIGHWAYS PURSUANT TO HRS 46-7 <br /> WHEREAS,the State and County own and/or control various public roads, highways, <br /> alleys, streets, ways, lanes,bikeways, bridges, and/or other real property highway-related <br /> interests throughout the Island of Hawai`i, and are responsible for the care and maintenance <br /> thereof; and <br /> WHEREAS, the County and the State intend to cooperate and assist each other with <br /> various road and/or road-related improvement projects on or for such public roads to better meet <br /> the public's overall transportation needs throughout the Island of Hawai`i by providing each <br /> other with various services, equipment, and/or material for each other's road and/or road-related <br /> improvement projects as convenient, necessary, and possible, and may agree to certain sharing of <br /> costs,reimbursements, and/or other forms of remuneration depending on the factual <br /> circumstances of a particular road and/or road-related improvement project; and <br /> WHEREAS,the County and the State wish to enter this Agreement to memorialize their <br /> general agreement and intention to provide one another with various services, equipment, and/or <br /> material for each other's road and/or road-related improvement projects as convenient, <br /> necessary, and possible, with particular types and terms for assistance for specific projects to be <br /> defined and agreed upon in various letters of intent, subject to a limitation of$2,000,000.00 in <br /> total value for assistance provided by either party for a particular project; and <br /> WHEREAS,the State, pursuant to the authority vested in the Director of Transportation <br /> under Hawai`i Revised Statutes, Section 264-31, is willing to perform work on or for County <br /> Highways; and <br /> WHEREAS, the County upon the request of the Director of Transportation and <br /> authorization by the County Council will be authorized to perform maintenance work on State <br /> 1 <br />
