Further, in the event inadvertent burials are found outside of the designated <br /> cemetery area,the protocols identified in the SHPD-approved Burial Treatment <br /> Plan and/or Preservation Plan shall be adhered to. <br /> R. The applicant, its successors or assigns shall subdivide and dedicate to the <br /> County, for the expansion of Clem Akina Park, not less than 1.69 acres of <br /> TMK(3) 2-6-008:026. The configuration and land area of the park expansion <br /> shall be determined in consultation with the Department of Parks and Recreation <br /> and shall be approved by its Director. The park expansion area shall be clearly <br /> identified as such on all plans submitted for subdivision of the subject properties <br /> and shall be free of any encumbrances or restrictions,unless specifically agreed to <br /> by the Director of the Department of Parks and Recreation. The applicant shall <br /> prepare and submit all documents necessary for dedication of the park expansion <br /> area in conjunction with Final Subdivision Approval for any portion of the <br /> rezoned area. Finally, the park,expansion area shall be dedicated to the County <br /> within one (1) year of Final Subdivision Approval or prior to the issuance of a <br /> building permit for a dwelling unit or accessory structure within the rezoned area <br /> whichever occurs first. <br /> S. The applicant shall make its fair share contribution to mitigate the potential <br /> regional impacts of the development with respect to parks and recreation, fire, <br /> police, solid waste disposal facilities and roads. The fair share contribution shall <br /> become due and payable prior to receipt of Final Subdivision Approval and shall <br /> be based on the actual number of additional residential lots created. The fair share <br /> contribution in a form of cash, land, facilities or any combination thereof shall be <br /> determined by the County Council. The fair share contribution may be adjusted <br /> annually beginning three years after the effective date of this ordinance, based on <br /> the percentage change in the Honolulu Consumer Price Index (HCPI).
