The intent of the Coastal Zone Management <br /> Program is to guide and regulate public and private uses in the CZM area with respect to <br /> coastal recreational resources, historic resources, public access to shoreline, scenic and <br /> open space resources, coastal ecosystems, marine resources, economic uses, coastal <br /> hazards, managing development, public participation and beach protection. The property is <br /> not located within the Special Management Area and is located over a mile from the <br /> nearest shoreline. There is no record of a designated public access to the shoreline or <br /> mountain areas traversing the property. Due to the property's distance from the shoreline, <br /> the rezone and subsequent subdivision will not impact any recreational resources, scenic <br /> and open space or visual resources, coastal ecosystems and marine coastal resources. The <br /> property has been previously cleared and cultivated in sugarcane, therefore the likelihood <br /> of any rare or endangered species, habitat or flora, cultural resources and practices, or <br /> archaeological sites on the property is remote. <br /> Lastly, this approval is made with the understanding that the applicants remain <br /> responsible for complying with all other applicable County, State and Federal <br /> governmental requirements in connection with the approved use, prior to its <br /> commencement or establishment upon the subject properties. Additional governmental <br /> requirements may include, but are not limited to, the issuance of building permits, the <br /> installation of approved wastewater disposal systems, compliance with the Fire Code, <br /> compliance with State Health Department environmental/sanitation/health-related <br /> regulations, installation of improvements required by the American with Disabilities Act <br /> (ADA), among many others. Compliance with all applicable governmental requirements is <br /> a condition of this approval; failure to comply with such requirements will be considered a <br /> violation that may result in enforcement action by the Planning Department and/or the <br /> affected agencies and/or commissions. <br /> Based on the above findings, approval of this change of zone request from an Agricultural <br /> 20-acres (A-20a) to Agricultural 5-acres (A-5a) zoning district would result in an appropriate <br /> land use pattern that is consistent with the General Plan, and will further the public necessity and <br /> convenience and the general welfare. <br /> The accompanying draft bill to amend Section 25-8-19 (North Hilo District Zone Map) is <br /> provided for your favorable consideration. Please note the proposed conditions of approval are <br /> attached to the draft bill. <br />
