NATE OF HAWAIJ <br /> f OiN' <br /> BILL NO. 88 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 3 (REFUSE DISPOSAL), <br /> SECTION 20-31, OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS <br /> AMENDED), RELATING TO THE DEFINITION OF "PUBLIC PROPERTY." <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. This amendment is proposed pursuant to a request from the Hawaii County <br /> Department of Environmental Management to amend the definition of"public property" <br /> contained in section 20-31 of the Code, to include real property owned by the State of Hawaii or <br /> Federal Government as well as the County of Hawaii. The department requests this change to <br /> authorize them to tow abandoned vehicles from State and Federal, as well as County property <br /> pursuant to section 20-3 8. <br /> SECTION 2. Chapter 20, article 3, section 20-31, of the Hawaii County Code 1983 (2016 <br /> Edition, as amended) is amended by amending the definition of "Public property"to read as <br /> follows: <br /> "Public property means all real property owned by the CountyH or State of <br /> Hawaii, or the Federal government." <br /> SECTION 3. Material to be repealed is bracketed and stricken. New material is <br /> underscored. In printing this ordinance,the brackets, bracketed and stricken material, and <br /> underscoring need not be included. <br /> SECTION 4. Severability. If any provision of this ordinance, or the application thereof to <br /> any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br />
